Civil Procedure Code, 1908 (CPC) – Order 23, Rule 1(3) – This case involves a Civil Revision Petition against the order of the Additional District Munsif Court, Manappari, in I.A.No.4 of 2023 in O.S.No.129 of 2012. The original suit was filed by the petitioner/plaintiff for a permanent injunction against the respondent/defendant, concerning access to the plaintiff’s property.

Subsequently, the plaintiff sought to withdraw the suit with liberty to file a fresh one, claiming that he had purchased the suit property and now required a declaratory relief in addition to the injunction. The defendant opposed the withdrawal, arguing that the application was filed belatedly (11 years after the suit was initiated) and prejudiced their defense.

Indian Registration Act, 1908 – Section 17, Indian Stamp Act – Section 35 – This Civil Revision Petition contests the order dated 22.02.2024 in I.A.No.82 of 2022 in O.S.No.19 of 2019, where the trial court dismissed an application filed by the defendants (revision petitioners) to mark an unstamped and unregistered release deed as evidence after paying the deficit stamp duty. The plaintiff (respondent) opposed this, arguing that the document required compulsory registration and proper stamping to be admissible.

The revision petitioners argued that the release deed, executed by the plaintiff’s mother, was crucial to demonstrate that the plaintiff had no right or interest in the suit property and they sought to pay the deficit stamp duty and introduce it as evidence, even for collateral purposes. They cited judgments supporting the admissibility of insufficiently stamped documents upon payment of duty and penalty.

Civil Procedure Code, 1908 (CPC) – Section 24 & Commercial Courts Act, 2015 – Section 2(1)(c)(vii) & 12-A – The petitioner sought transfer of O.S.No.470 of 2024 from the Additional District Court, Palani, to the Commercial Court, Dindigul, under Section 24 of the Civil Procedure Code (CPC). The suit involved a specific performance of a sale agreement.

The petitioner argued that the suit qualifies as a commercial dispute under Section 2(1)(c)(vii) of the Commercial Courts Act, 2015, as the property in question is described as “ETP land” (Effluent Treatment Plant land) in the plaint document. The court relied on the description in the plaint document, indicating that the property is being used for trade/commerce, thus falling under the Commercial Courts Act, 2015.

Specific Relief Act, 1963 – Section 22 – This Civil Revision Petition was filed against the order dismissing the Execution Petition (E.P.) filed by the revision petitioner, who is the legal heir of the original plaintiff in a suit for specific performance. The suit was initially filed in 1978 and was decreed in favor of the plaintiff, which was later confirmed by the High Court in 2000. The revision petitioner, as a beneficiary of a Will executed by the original plaintiff, received the sale deed but was not given possession of the property, leading to the filing of the E.P.

The Execution Court dismissed the E.P.

Code of Civil Procedure, 1908 (CPC) – Section 20

This case involves an appeal by the defendants against a decree passed by the Principal District Court, Cuddalore, ordering them to pay Rs. 88,55,120/- with interest to the plaintiff. The plaintiff had sued for recovery of unpaid rent for a Schwing Truck Mounted Concrete Pump hired by the defendants. The defendants contested the suit, arguing lack of territorial jurisdiction in Cuddalore, limitation, and disputing the agreed rental amount.

Indian Partnership Act, 1932 – Section 14; Order II Rule 2 of the Civil Procedure Code (CPC) – This case involves a second appeal filed by the plaintiff, challenging the dismissal of his suit for dissolution of a partnership firm (“Hercules Weigh Bridge”), rendition of accounts, and a 1/8th share in the firm’s assets and profits. The plaintiff claimed he and the defendants were partners based on a 1984 agreement.

The defendants contested the suit, arguing that the property was the first defendant’s exclusive property, the suit was barred by Order II Rule 2 CPC due to a prior suit (O.S.No.325/2004) seeking a share of compensation for acquired land, and that the property was not purchased with partnership funds.

The trial court dismissed the suit, finding the property was in the first defendant’s name, and the firm lacked the financial capacity to purchase it.

Hindu Succession Act, 1956 – Section 14(1) & 14(2); Hindu Women’s Rights to Property Act, 1937 – Sections 3(2) & 3(3) – This case revolves around a suit filed by the plaintiff (first respondent) seeking declaration of title, permanent injunction, and mandatory injunction concerning certain properties. The plaintiff claimed ownership through sale deeds from Chinnammal, who inherited the property from her husband, Mannar Naidu. The defendant (appellant) contested this, asserting the properties were ancestral and Chinnammal only had a limited life estate via a maintenance deed (Ex.B24) from Devaraj Naidu.

The trial court decreed the suit in favor of the plaintiff, a decision upheld by the appellate court.

The Indian Easements Act, 1882 – Section 13 and 19 and Transfer of Property Act, 1882 – Section 8 – The case originates from a suit filed by the plaintiff seeking a declaration that the defendant has no right of way through their land and a permanent injunction. The trial court dismissed the suit, but the appellate court reversed the decision and decreed the suit in favor of the plaintiff. The defendant then filed a Second Appeal challenging the appellate court’s judgment.

The dispute concerns a cart track used to access the defendant’s land.

Police Act, 1861 – Section 30 (3); Police Standing Order (PSO) 380, 699(4) (5) –  This Writ Petition challenges an order demanding Rs. 66,91,276 as bandobust charges for the Chithirai Venkudai Thiruvizha festival. The petitioner argues that the demand, based on G.O.Ms.No. 139 and PSO 380, violates Section 30 of the Police Act, 1861, which prohibits charging fees for procession licenses.

Constitition of India Article 226 – The writ petition was filed by a wife (Petitioner 1) seeking to be declared the guardian of her comatose husband, Kajendran, to manage his assets for his medical treatment and family welfare. The husband suffered severe injuries in an accident and is in a vegetative state, requiring extensive medical care. Petitioners 2 and 3, the couple’s children, support the mother’s petition. The petitioner cites financial constraints in meeting medical and family expenses without access to her husband’s assets.
