The Protection of Women from Domestic Violence Act, 2005 – Sections 3, 12(1) & (2), 18(a) & (b), 19(a), (b) & (c), 20(1)(d) and 22 – This case involves a challenge to the orders of the lower courts which directed the petitioner (husband) to pay compensation and maintenance to the respondent (wife) under the Protection of Women from Domestic Violence Act, 2005. The husband claimed to have divorced his wife via Talaq and subsequently married another woman. The wife disputed the validity of the Talaq and alleged domestic violence due to the second marriage.

The court examined whether contracting a second marriage by a Muslim man during the subsistence of the first marriage constitutes domestic violence under the Act.

Civil Procedure Code, 1908 (CPC) – Order 7 Rule 11 – The judgment pertains to a revision petition challenging the dismissal of an application filed under Order 7 Rule 11 of the CPC, seeking rejection of a plaint. The plaintiffs filed a suit for partition, claiming a share in a property that originally belonged to their maternal grandfather. After his demise, the property devolved to their mother, who subsequently sold it. The plaintiffs challenged the sale deeds and sought partition.

Code of Civil Procedure, 1908 (CPC) – Order 39 Rules 1 and 2, Order 43 Rule 1, Section 104, Section 151 – The appeal concerns an order of the High Court of Gujarat that overturned the trial court’s grant of a temporary injunction in a property dispute. The plaintiffs filed a suit seeking declaration, cancellation of a sale deed, and a permanent injunction against the defendants, alleging that the defendant no. 1 fraudulently transferred property to defendant no. 3 based on a misused power of attorney.

Tamil Nadu Minor Inams (Abolition and Conversion into Ryotwari) Act, 1963 – Section 8(1)(a), 21(7)(a) – This case involves a dispute over lands originally belonging to Sri Meenakshi Sundareshwar Temple, which were entrusted to Sivagangai Samasthanam for income generation. Muthusami Thevar and Gurunatha Thevar claimed ownership based on a 1923 purchase and obtained a patta under Section 8(1) of the Tamil Nadu Minor Inams (Abolition and Conversion into Ryotwari) Act, 1963, for performing “Annaabhisekam Kattalai.” This was challenged by the temple, but the tribunal upheld the patta.

The temple later filed a civil revision petition (CRP) seeking to overturn the tribunal’s order, arguing that the patta was obtained fraudulently and the land was inalienable. Meanwhile, the legal heirs of Muthusami Thevar and Gurunatha Thevar filed writ petitions seeking issuance of revenue pattas based on the earlier orders.

Negotiable Instruments Act, 1881 – Section 138 & 141; Code of Criminal Procedure, 1973 – Section 482 – This case involves an appeal against a High Court judgment that rejected petitions seeking to quash a complaint filed under Section 138 of the Negotiable Instruments Act, 1881 (NI Act). The appellant, a former director of Respondent No. 2 Company, was implicated due to dishonored cheques issued by the company.

The appellant resigned from his position on June 21, 2019, and his resignation was officially recorded with the Registrar of Companies on June 26, 2019.

Civil Procedure Code, 1908 (CPC) – Order XXI Rule 58, Order XXI Rule 64, Order XXI Rule 66, and Order XXI Rule 90 – This case involves a challenge to an auction sale in execution proceedings. The original suit (O.S.No.70 of 2005) was filed for recovery of money and resulted in an ex parte decree. In execution (E.P.No.46 of 2008), property was attached and brought to sale. The Civil Revision Petitioner (CRP) filed an application under Order XXI Rule 58, claiming ownership of the property, which was dismissed for default.

The Code of Civil Procedure 1908 (CPC) Section 92; Indian Trust Act – Registered Trust – This case involves a dispute over the trusteeship of the “Congress Ponvizha Mandapam” Trust. The plaintiffs, claiming to be the rightful trustees based on a registered Trust Deed from 1954 and subsequent appointments, filed a suit seeking a declaration of their trusteeship and an injunction against the defendants, who claimed to be appointed by the Congress Committee.

The defendants argued that the plaintiffs should have obtained permission under Section 92 of the Civil Procedure Code (CPC) and that the Trust was under the control of the Congress party. The Trial Court dismissed the suit.

Waqf Act, 1995 (as amended in 2013) – Section 32 and 63 – This case revolves around a challenge to an order by the Waqf Tribunal regarding the T.O. Mohamed Thambi Waqf in Sivagangai District. The petitioner, a Jamath (association), contested the tribunal’s decision, which directed the Tamil Nadu Waqf Board to register the waqf as separate, prepare a proforma indicating “hereditary” succession for the mutawalli (manager) post, conduct an inquiry among the founder’s legal representatives, and appoint a mutawalli per the Waqf Act, 1995, as per the founder’s intentions.

Civil Procedure Code, 1908 (CPC) – Order VI Rule 17 and Order 22 Rule 4(4) – This Civil Revision Petition was filed against an order passed by the District Munsif cum Judicial Magistrate, Cheyyur, regarding an application to amend the plaint in O.S. No. 55 of 2020. The plaintiffs sought declarations, injunctions, and easement rights concerning the suit properties.

Arbitration and Conciliation Act, 1996 – Section 31(7), 33 – This case concerns a dispute arising from a construction contract awarded by the North Delhi Municipal Corporation (appellant) to M/s. S A Builders Ltd (respondent). The dispute went to arbitration, and the arbitrator passed an award in favor of the respondent.

Key Issue: Whether the arbitrator had the jurisdiction to issue a clarification to the award several years after the original award was passed, and the interpretation of Section 31(7) of the Arbitration and Conciliation Act, 1996 regarding interest calculations.

The appellant argued that the arbitrator became functus officio after the initial award and could not issue a clarification.
