Code of Civil Procedure, 1908 (CPC) – Section 92 – This Second Appeal challenges the reversal of a Trial Court’s decision by the First Appellate Court in a case concerning the B.M.Nanjian Trust. The plaintiff, a life trustee, was removed from the trust by a resolution, leading him to file a suit for a permanent injunction and declaration against the other trustees. The plaintiff contended that the defendants were mismanaging the trust.

The Trial Court ruled in favor of the plaintiff, declaring the removal resolution invalid and restraining interference with his duties.

Indian Contract Act, 1872 – Section 23 – This case revolves around a dispute between a plaintiff (an Educational Trust) and the defendant (a bank) regarding the refund of front-end fees paid for a loan that was ultimately not disbursed. The plaintiff sought a loan of Rs. 6 crores for construction purposes. The bank sanctioned the loan but introduced new conditions during the process, including the requirement for the plaintiff to execute a mortgage in favour of a third-party trustee, which was not part of the initial agreement.

The Tamil Nadu Panchayat Act Section 132 – The case involves two Second Appeals filed against the judgment and decree in A.S.Nos.30 & 35 of 2011, which modified and reversed the judgment and decree in O.S.No.98 of 2010 and O.S.No.10 of 2009. The plaintiff filed two suits: one for a permanent injunction and another for damages, claiming ownership of the property through registered sale deeds. The defendant, a Panchayat, alleged that the land was a communal graveyard and the plaintiff was an encroacher.

The Trial Court decreed the injunction suit but dismissed the compensation suit.

Code of Civil Procedure, 1908 (CPC) – Order 8 Rule 9 – This Civil Revision Petition challenges the order of the Additional District Judge, Krishnagiri, in I.A.No.10 of 2022 in O.S.No.88 of 2020, which allowed defendants 1 to 3 to file an additional written statement in a suit for specific performance. The defendants sought to introduce an unregistered Panchayat deed to support their title, which was questioned after the impleadment of the civil revision petitioner (4th defendant).

The petitioner argued that the same document had been previously rejected in O.S.No.19 of 2018, a suit for declaration of title. The High Court, however, held that the rejection in the title suit did not preclude its admissibility in the specific performance suit, as the purpose of the document was different.

Civil Procedure Code, 1908 (CPC) – Order 8 Rule 6A – This Civil Revision Petition challenges the order by the Principal District Munsif Court at Alandur, which returned Counter Claim SR.No.10600 of 2022 in O.S.No.185 of 2020. The original suit (O.S.No.185 of 2020) filed by the plaintiff seeks a permanent injunction to prevent the defendants (the revision petitioners) from interfering with her possession of a property measuring 572 sq.ft. The defendants filed a counter claim asserting ownership over an adjacent 1303 sq.ft, alleging the plaintiff is trying to take possession of their property under the guise of purchase.

The District Munsif repeatedly returned the counter claim, stating that it concerned a different property than the subject matter of the plaint.

Indian Easements Act, 1882 – Easement by Grant – This case concerns a dispute over a cart track claimed as an easementary right by the plaintiff, based on a prior partition decree (Ex-A.1) and settlement deed (Ex-A.2). The plaintiff’s property (Suit A) and the defendant’s property originally belonged to one Andimuthu Gounder, who divided the properties between his son and daughter, Nagarathinam. Nagarathinam, the plaintiff’s predecessor, was granted an easement by way of cart track (Suit B) through what is now the defendant’s land.

The trial court decreed the suit in favor of the plaintiff, recognizing the easementary right.

This case was filed by the plaintiff, a construction company, to recover Rs.46,29,810/- with interest and Rs.1 crore as damages from the defendant bank. The plaintiff claimed the bank unreasonably withheld monies, securities, and funds by unlawfully appropriating Rs.32,71,412/- from a fixed deposit. The bank argued it was entitled to change credit facility terms and that the appropriation was for the refund of concessions availed by the plaintiff when it decided to switch banks. The central dispute revolved around the validity and enforceability of a condition introduced by the bank stating that concessions received would have to be refunded if the plaintiff availed credit facilities from another bank within 12 months.

Indian Trust Act – Section 22 & 34 – This revision petition was filed by a third party against the order passed in Trust O.P.No.47 of 2017, which allowed the sale of trust properties based on the claim of the first respondent as the hereditary trustee of Siru Kaala Sandhi Kattalai. The petitioner, a legal heir of the M.P. family, contended that the property belonged to his family and was leased to the first respondent’s family for cultivation, with rent collected for the trust. The first respondent claimed the property as ancestral, given to the trust by his grandfather.

Hindu Succession Act, 1956 – Section 17 – This case revolves around a dispute over the inheritance of property originally belonging to Madamma Kochappi, who died issueless in 1961. The plaintiff claimed the right to redeem the property based on a sale deed from Kamakshi and Lakshmi, who they alleged were the heirs of Madamma Kochappi’s husband’s brother.

The defendants contested this claim, arguing that Madamma Kochappi belonged to the ‘Nulaya’ community, which follows Marumakkathayam law. They contended that Section 17 of the Hindu Succession Act, which deals with persons governed by Marumakkathayam law, should apply.

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 – Section 21(2)(a) and Section 4 – This case involves revisions against concurrent orders from the Rent Controller and the appellate authority, confirming the eviction of tenants under Section 21(2)(a) of the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (the “New Act”).

The landlord sought eviction because the tenants did not execute a tenancy agreement as mandated by Section 4 of the New Act within 575 days of its commencement. The tenants claimed readiness to execute an agreement, arguing the landlord’s inaction should prevent eviction.

The court noted that the New Act aims to regulate rent through written agreements, even for existing tenancies.
