Specific Relief Act, 1963 – Section 16; Indian Evidence Act, 1872 – Section 45 – This appeal challenged a decree for specific performance of a sale agreement (Ex.A1) from 24.10.1999, where the defendants agreed to sell property to the plaintiff for Rs. 20,28,750/-, receiving an advance of Rs. 2,00,000/-.
The agreement specified a four-month completion period.

Based on this decree, a Sale Deed was executed, and an order for delivery of possession was subsequently issued in E.P. No.51 of 2017, triggering one of the present Civil Revision Petitions.

The Appellant completed a dredging project for the Respondent. A dispute arose over the final bill, specifically Claim No. 7 for ‘idle time’ charges of a Backhoe Dredger (BHD).
