Tamil Nadu Cooperative Societies Act, 1983 (TNCS Act) – Sections 90, 167, Tamil Nadu Cooperative Societies Rules, 1988 (TNCS Rules) – Rule 140 – The petitioner challenged interim and absolute attachment orders issued by the First Respondent on his property. This property was purchased from the wife of a suspended cooperative society secretary, Mr. Rajendran, against whom allegations of fund misappropriation were made. The attachment was ordered pending a dispute resolution application (ARC.No.3 of 2024) under Section 90 of the TNCS Act.

Tamil Nadu Specified Commodities Markets (Regulation of Location) Act, 1996 (Tamil Nadu Act 24 of 1996) – Sections 2(5), 2(6), 2(8), 5, 25 – The petitioner, an association of traders, challenged a tender notification issued by the Chennai Metropolitan Development Authority (CMDA) for the sale of godowns in the Koyambedu market. The petitioner contended that the godowns were meant for traders’ storage and their sale by CMDA violated Act 24 of 1996, asserting that the Market Management Committee (3rd respondent) alone had jurisdiction, as the property vested in it under Sections 5 and 25 of the Act.

The Court noted that similar tender processes for other godowns had been upheld in previous High Court and Supreme Court rulings, which explicitly directed CMDA to conduct a fresh tender for securing the best market price. The petitioner’s challenge was an indirect attempt to overturn these earlier decisions.

Motor Vehicles Act, 1988 – Compensation under the Act – Indian Penal Code, 1860 (IPC) – Sections 279, 304-A – This appeal challenged a Motor Accident Claims Tribunal (MACT) Award of Rs. 24,96,200/- to the parents of a deceased MBA student. On 26.08.2015, Gopal (20), a First Year MBA student, died after a Government Bus, driven rashly and negligently by its driver, collided with a stationary school bus. A criminal case under IPC Sections 279 and 304-A was registered against the driver.

Motor Vehicles Act, 1988 (MV Act) – Sections 163-A, 166 – This Civil Miscellaneous Appeal challenged an award by the Motor Accidents Claim Tribunal. The claimant’s wife, Manimegalai, died due to a rash and negligent accident involving a car insured with the 2nd respondent. The claimant sought Rs. 28,00,000/- compensation, asserting the deceased earned Rs.

Motor Vehicles Act, 1988 (MVA) – Sections 2(30), 50, and 51 – This Civil Miscellaneous Appeal contested a Motor Accident Claims Tribunal’s judgment, which awarded Rs. 19,50,000/- as compensation. The Tribunal had found that the 5th respondent’s negligent driving caused the fatal accident of Mohanan. Crucially, it fixed the liability for this compensation on ICICI Bank, the financier of the offending vehicle.

Hindu Marriage Act, 1955 – Section 13(1)(i-a) – This judgment concerns an appeal against a divorce decree granted by the Family Court, Dharmapuri, in a petition filed by the husband (respondent) under Section 13(1)(i-a) of the Hindu Marriage Act, 1955, seeking dissolution of marriage on the ground of cruelty. The marriage took place on March 26, 1999.

The wife (appellant) had previously filed a divorce petition (F.C.H.M.O.P.No. 223 of 2014) alleging the husband was a womanizer, addicted to alcohol, and living a wayward life, which was later dismissed for default.

Hindu Marriage Act, 1955 (HMA) – Sections 9, 13(1)(i-a); Family Courts Act, 1984 – Section 19 – This case concerned cross-appeals stemming from a Family Court judgment. The husband sought divorce under Section 13(1)(i-a) of the HMA, alleging cruelty due to his wife’s demand for a luxurious lifestyle, disrespect towards his family, suicide threats, and desertion. The wife filed a petition under Section 9 of the HMA for restitution of conjugal rights, counter-alleging dowry demands, harassment, and forced abortions, while affirming her desire to live with him.

The Family Court dismissed the husband’s divorce petition, finding his cruelty allegations unproven and contradictory.

The Indian Evidence Act, 1872 Section 63, read with The Indian Succession Act, 1925 Section 68 –  proving the Will – Permanent injunction decree – This Second Appeal contested the First Appellate Court’s reversal of a permanent injunction decree. The plaintiffs asserted rights over suit properties based on a Will (Ex.A.2) by Chellamuthu, bequeathing his share to his wife Perumayee for life, then to plaintiffs 3 & 4. They claimed common enjoyment and challenged Perumayee’s subsequent settlement deed (Ex.B.1) to her father as invalid.

Conversely, the defendants argued an oral partition among the brothers, denying the Will’s authenticity due to suspicious circumstances.

Hindu Succession (Tamil Nadu Amendment) Act, 1989 (Tamil Nadu Act 1 of 1990) – Section 29-A – This appeal challenged a preliminary decree granting plaintiffs (daughters) a 3/4th share in ‘A’ and ‘B’ Schedule properties. The plaintiffs contended that all properties, including those acquired by their father (1st defendant), were joint family assets purchased from the income of extensive ancestral lands (34 Acres). They asserted their coparcenary rights under the Act, having married after its commencement.

The 2nd defendant (another daughter and appellant) argued that certain properties (A-Schedule Item Nos.

Civil Procedure Code, 1908 (CPC) – Order VII Rule 11; Cantonments Act, 2006 – Sections 238(1), 241, 250, 338, 340 – This Civil Revision Petition challenged the dismissal of an application to reject a plaint. The original suit sought compensation for alleged illegal demolition by the Cantonment Board and a mandatory injunction for renovation permission. Defendants argued the suit was barred by Sections 250 and 338 of the Cantonments Act, 2006, as the Plaintiff should have pursued statutory remedies like appeal under Section 340.

The Plaintiff contended that the Defendants violated principles of natural justice and acted mala fide, seeking common law remedies for damages, which the Cantonments Act does not provide.
