Industrial Disputes Act, 1947 – Section 2(k), 2(p), 18 – This writ petition was filed by the Management of Caterpillar India Private Limited challenging the order of the Industrial Tribunal, Chennai, in I.A.No.1 of 2024 in OP No.18 of 2023. The management sought a direction to the Tribunal to pass an award in terms of Section 18(1) settlement signed with the majority of workmen.

The Management contended that a valid Section 18(1) settlement was reached with a majority of the workmen and the Tribunal erred in dismissing its application for an award based on that settlement. The Union argued that individual settlements are impermissible for collective disputes under Section 2(k) of the Industrial Disputes Act and that the management engaged in unfair labor practices by refusing to negotiate with external office bearers.

Original Side Rules Order 34 Rule 1 read with Letters Patent Clause 15 – These intra-court appeals were filed by third parties, who were elected office bearers, challenging the single judge’s order that restrained the Administrator, appointed by the court, from conducting elections. The appellants argued that the interim order impacted their rights without a hearing, making it appealable under Clause 15 of Letters Patent. The respondents contended that the order was merely an interim injunction and the appeals were not maintainable. The court considered precedents defining “judgment” under Clause 15 of Letters Patent, emphasizing the effect of an order on the rights of parties and the proceedings.

Specific Relief Act, 1963 – This appeal concerns a suit filed by the plaintiff seeking specific performance of a sale agreement and a declaration that a subsequent sale deed executed by the first defendant in favor of the second defendant is null and void. The plaintiff claimed that the first defendant agreed to sell the property for Rs. 24,00,000/-, received Rs. 21,00,000/-, and executed a sale agreement and a power of attorney.

Civil Procedure Code, 1908 (CPC) – Section 96, Order XXX Rule 10; Negotiable Instruments Act, 1881 (NIA) – Sections 20, 118(a) – This First Appeal challenged a trial court’s decree for Rs.12,00,000/-, awarded to the plaintiff based on a dishonoured cheque. The plaintiff claimed the amount was a hand loan, and the cheque was issued for its repayment. The defendant denied the loan, alleging misuse of a signed blank cheque given for business purposes (Sri Balaji Traders) and asserting a lack of consideration, material alteration, and non-joinder of the firm.

The trial court, noting the defendant’s admission of handing over signed blank cheques, invoked the presumption under Section 118(a) of NIA, finding it unrebutted.

The Civil Procedure Code (CPC) Section 100 – This Second Appeal concerned a suit for permanent injunction regarding Gramanatham land (S. No. 79/4). The plaintiff claimed possession based on patta and revenue records, asserting he paid taxes for over 12 years.

Constitution of India – Articles 14 & 16 – The petitioners, working as part-time Veterinary Assistants for over 12-15 years, sought regularisation of their services, claiming they performed full-time duties against sanctioned posts. They sought benefits under G.O.Ms. No. 22, Personnel and Administrative Reforms Department, dated 28.02.2006, and argued that denying regularisation was discriminatory as similarly placed workers had been absorbed.

Indian Succession Act, 1925 Section 63 – This appeal before the Madras High Court challenged the trial court’s preliminary decree for partition, which disbelieved an unregistered Will dated 07.02.2011. The suit properties belonged to the deceased Thangaraj. His wife, elder son, and daughter (plaintiffs) claimed Thangaraj died intestate, making the Will, which bequeathed all properties to the younger son (first defendant), fabricated. The first defendant asserted the Will’s authenticity.

The Indian Succession Act, 1925 Section 119 –  The case concerns an appeal challenging a preliminary partition decree for property originally owned by Vachala Ammal. She bequeathed “A” schedule property absolutely to her four sons through a registered Will dated 21.03.1965. The Will indicated her husband, Govindhan, would manage the property until the last son attained majority and explicitly stated children from his second wife would have no right.

Two of Vachala Ammal’s sons died as bachelors.

Tamil Nadu Civil Services (Discipline and Appeal) Rules – Rule 9A. – The appellant challenged his dismissal from government service after disciplinary proceedings for charges including loss to the exchequer, fabrication, misappropriation, and corrupt practice, following the Writ Court’s dismissal of his petition. The appellant argued the dismissal stemmed from self-serving charges, hearsay evidence, a perverse enquiry, and a harsh punishment. He also cited Rule 9A of the Tamil Nadu Civil Services (Discipline and Appeal) Rules concerning multiple government servants. The respondents countered that evidence was correctly appreciated, charges were serious, and judicial review’s scope does not permit re-appreciation of facts.

Civil Procedure Code, 1908 (CPC) – Section 96, Section 100, Order VIII Rule 6-A, Order 41 Rule 33; Specific Relief Act, 1963 (SRA) – Section 38, Section 41 – The plaintiff sought a permanent injunction based on an ex parte specific performance decree (O.S. No. 99 of 2005) obtained against the first defendant, concerning a sale agreement from 1997. However, the third defendant had purchased the property in 1998, prior to the specific performance suit, and was not a party to it.
