Transfer of Property Act, 1882 – Section 60; Code of Civil Procedure, 1908 – Order 34 Rules 7 & 11; Indian Evidence Act, 1872 – Section 101 – This case involves a Second Appeal filed against the judgment of the First Appellate Court, which had allowed the plaintiff’s (M.K.Kannan) suit for redemption of two mortgage deeds executed with the defendant (Park Town Benefit Fund Ltd). The plaintiff claimed to have repaid the mortgage amount, but the defendant disputed the same, leading to the initial dismissal of the suit by the trial court.

The core issue revolves around whether the plaintiff discharged the mortgage debt, the burden of proof for such discharge, and the applicable interest rate pendente lite. The High Court reformulated the substantial questions of law to address these points specifically, emphasizing the plaintiff’s responsibility under Section 101 of the Indian Evidence Act, 1872 to prove the repayments made.

Specific Relief Act, 1963 – Section 16(c) – This case involves an appeal against a Trial Court’s decision to grant specific performance of a registered sale agreement. The plaintiff filed a suit seeking specific performance, asserting that the defendant had agreed to sell property for a consideration of Rs. 13,12,500/-, with Rs. 7,50,000/- paid as advance.

Civil Procedure Code, 1908 (CPC) – Order 23 Rule 1 – This revision petition challenges the Trial Court’s decision to allow the plaintiff to withdraw a suit (O.S.No.87 of 2010) with the liberty to file a fresh suit on the same cause of action, invoking Order 23 Rule 1 of CPC. The defendant argued that the plaintiff failed to demonstrate any formal defect in the plaint or provide sufficient grounds for seeking such withdrawal. The plaintiff contended that they were improperly advised and needed to include a relief for partition, which they hadn’t initially sought.

The High Court reviewed the case, noting that the plaintiff had already acknowledged an oral partition in the original plaint.

Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (TNRRRLT Act, 2017) Section 2(f) – This case involves a tenant petitioning against concurrent eviction orders from the Rent Court and Rent Tribunal. The tenant argued that their possession was akin to a Usufructuary Mortgage (Othi) due to an interest-free deposit of Rs. 6,50,000 paid to the landlord’s brother, and thus, the TNRRRLT Act, 2017 shouldn’t apply. The tenant claimed they occupied the premises without rent liability in lieu of the deposit.

Specific Relief Act, 1963 – Section 16(c) – This case concerns a second appeal against the reversal of a trial court’s decree, which had ordered the refund of an advance payment for a property sale. The plaintiff sought the refund of Rs. 5,00,000 paid as advance to the defendants, contending that the defendants failed to rectify title discrepancies. The first appellate court reversed the trial court’s decision, stating that the plaintiff defaulted.

The Registration of Births and Deaths Act, 1969 – Section 13(3) – This case concerns a writ petition filed by an individual seeking the registration of his father’s first wife’s (Alagammal) death and the issuance of a death certificate. The Revenue Divisional Officer (RDO) declined the request due to the non-submission of the First Information Report (FIR) and post-mortem report, as Alagammal’s death was due to suicide.

The petitioner argued that these documents should not be mandatory if other evidence confirms the death. The court considered Section 13(3) of The Registration of Births and Deaths Act, 1969 and Rule 9(3) of the Tamil Nadu Registration of Births and Deaths Rules, 2000, along with G.O (Ms) No.324, Revenue and Disaster Management Department, dated 28.06.2023, which outlines the procedures for late registration of deaths.

Civil Procedure Code, 1908 (CPC) – Order 41 Rule 5(1) and Rule 5(3) – This judgment addresses a Special Leave Petition against a High Court order that stayed the execution of a money decree without requiring the judgment debtor (Amazon Tech) to deposit the decretal amount. The original suit involved trademark infringement claims by the plaintiffs (Beverly Hills Polo Club) against the defendant. The High Court granted the stay based on several factors:

Representation of the People Act, 1951 (RP Act) – Section 83 – This case concerns the procedural requirements for filing an election petition, specifically focusing on the affidavit in Form 25 required under Section 83(1)(c) of the RP Act, read with Rule 94-A of the Conduct of Elections Rules, 1961, when alleging corrupt practices. The Respondent (original Election Petitioner) challenged the Appellant’s election, citing incomplete disclosure of assets, liabilities, criminal antecedents and discrepancies in EVM numbers. The Appellant sought rejection of the petition based on non-joinder of necessary parties, vague allegations, and non-compliance with the Form 25 affidavit requirement.

The High Court dismissed the Appellant’s application, finding substantial compliance with the affidavit requirement and granting the Respondent time to file a fresh affidavit.

The Transfer of Property Act, 1882 Section 52 – This case concerns a dispute over a 2-foot strip of land, claimed as a common lane, between the properties of the plaintiff (appellant) and the defendant (respondent). The plaintiff sought a declaration of title, permanent injunction, and mandatory injunction to remove encroachments made by the defendant on the disputed lane. The trial court ruled in favor of the plaintiff, but the first appellate court reversed this decision, citing the “common lane” recital in the plaintiff’s property deed. Indian Registration Act, 1908 – Section 17; Indian Stamp Act – Section 35, 36 & 49; Evidence Act – Section 58 – This revision petition was filed by the defendant challenging the trial court’s order to impound a lease agreement dated 01.01.2005. The defendant argued that the photocopy of the lease agreement (Ex.A14) was improperly marked because the original was missing, and the document was unstamped and unregistered. The defendant also argued that the document is inadmissible even for collateral purposes to establish the quantum of rent. The plaintiff argued that the defendant admitted to the lease’s execution, making it admissible for collateral purposes, and offered to pay the deficit stamp duty and penalty.
