(Challenging Administrative Transfer Orders)
The Constitution of India Article 226; The Industrial Employment (Standing Orders) Act, 1946 - Petitioners, bus drivers and conductors, challenged transfer orders, alleging they were punitive, arbitrary, 'mala fide', and void as the respondent Corporation's Standing Orders lacked a transfer clause. They cited instances of false complaints, victimization, and personal hardship. Respondents asserted transfers were administrative, an incidence of service, and justified for efficiency, denying 'mala fide' and arguing against judicial interference.
The Court held transfers are an incidence of service, challengeable only for incompetent authority or proven 'mala fide', finding the latter unsubstantiated.
