(Arbitration Award - Specific Performance of Determinable Contract)

Arbitration and Conciliation Act, 1996, Sections 34, 34(2A); Specific Relief Act, 1963, Section 14(d); Indian Easements Act, 1882, Section 52 - This appeal challenged an order dismissing a Section 34 petition filed by the Railways against an arbitral award. The respondent was granted a license to operate a catering stall, which was later terminated by the Railways due to alleged irregularities. The Arbitrator found the termination unjustified and directed the continuation and renewal of the license for an additional three years. The Railways contended that the arbitral award suffered from patent illegality, arguing that the license agreement was a determinable contract.

(Maintainability of Order 21 Rule 58 CPC in Execution for Possession)

Code of Civil Procedure, 1908 (CPC) – Order 21 Rule 58, Section 47 - Transfer of Property Act, 1882 – Section 53 - The appellant, a decree-holder, secured a specific performance decree, followed by a court-executed sale deed. When filing E.P.No.90 of 2019 for vacant possession, the 1st respondent (a temple) moved an Order 21 Rule 58 CPC application, claiming the property was endowed and inalienable. The executing court allowed this, dismissing the E.P. and annulling several registered documents, including a Will and settlement deeds.

(Protection of Dowry Givers under Dowry Prohibition Act)

The Dowry Prohibition Act, 1961 (DP Act)Sections 3 and 7(3) of, alongside Section 498A of the Indian Penal Code, 1860 (IPC), and Section 161 of the Code of Criminal Procedure, 1973 (CrPC) - The petitioner (husband) sought an FIR against his wife and her family for "giving dowry" under Section 3 DP Act. His complaint was based exclusively on statements made by his wife and her family under Section 161 CrPC, during the investigation of an FIR previously filed by the wife against him for dowry harassment (Section 498A IPC, Section 3 DP Act for taking dowry).

The petitioner's attempts to register this counter-FIR were rejected by the Judicial Magistrate, Sessions Judge, and the High Court. These courts reasoned that such a direction would amount to reinvestigation or that no cognizable offence was adequately made out based solely on the presented facts.

(Motor Accident Compensation - Insurer Liability and Disability Enhancement)

The Motor Vehicles Act, 1988 under Section 149, 165, 168, 173, seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal, Tiruppur, and challenging the exoneration of the Insurance Company. The accident occurred on February 27, 2019, when a Light Goods Vehicle (LGV) driven negligently by the 1st respondent collided with a motorcycle, injuring the rider (MCOP No. 991/2019) and his pillion rider son (MCOP No. 987/2019).

The Tribunal found the 1st respondent negligent but exonerated the 2nd respondent (Insurance Company) on the grounds that the 1st respondent lacked an effective driving license, violating policy conditions and MV Act provisions.

(Motor Accident Claim - Death during loading in a private godown - Forum and Legal Heirship)

This Civil Miscellaneous Appeal challenged an award by the Motor Accident Claims Tribunal which dismissed a claim petition for compensation.

The Motor Vehicles Act, 1988, and the Workmen's Compensation Act (now Employee's Compensation Act), 1923, along with Section 174 of the Code of Criminal Procedure, 1973 - The appellants (original petitioners) sought compensation for the death of Murugan, a loadman. Murugan died after a grain bag fell on him from a halted lorry (TN 59 D 6089) while he was loading it in a private godown. An FIR was registered under Section 174 Cr.P.C.

(Quashing of Charge for Abetment of Suicide)

The Indian Penal Code, 1860Sections 306 (Abetment of suicide) and 34 (Acts done by several persons in furtherance of common intention) read with Section 107 (Abetment of a thing) of, and Sections 438 and 442 of the Bhartiya Nyaya Suraksha Sanhita, 2023 - The appellant challenged an order of the Chhattisgarh High Court which had refused to quash a charge framed against him under Section 306 read with Section 34 of the Penal Code. The charge stemmed from the suicide of Komal Sahu by hanging. The First Information Report indicated suicide, and a subsequent investigation implicated the appellant and the deceased's wife, Revati Bai, alleging illicit relations between them and Revati Bai's insults towards the deceased in the appellant's presence, which supposedly led Komal Sahu to commit suicide.

The appellant contended that the prosecution material lacked sufficient evidence to establish abetment, specifically arguing the absence of any proximate act of instigation, a suicide note, or definitive proof of illicit relations beyond hearsay.

(Motor Accident Compensation)

The Indian Penal Code (IPC) Sections 279, 337, 304A. The case implicitly falls under the Motor Vehicles Act for compensation claims. This Civil Miscellaneous Appeal was filed by the Insurance Company against the award dated 28.01.2020, passed by the Motor Accident Claims Tribunal, Tiruchirapalli, in M.C.O.P.No.1285 of 2015. The Tribunal had originally awarded a sum of ₹84,94,334/- as compensation for the death of one Rengarajan.

The deceased, Rengarajan, a Senior Accounts Officer in BHEL, Trichy, earning approximately ₹1,30,000/- per month, died on 23.06.2015, following a motor accident on 12.06.2015.

(Motor Accident Compensation Enhancement)

The Motor Vehicles Act Section 173, seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal. The appellant/claimant was injured in an accident on October 18, 2018, when his two-wheeler, while waiting to cross the road, was hit by a car driven rashly and negligently. He sustained multiple grievous injuries and claimed Rs. 15,00,000/- in compensation.

The Civil Procedure Code, 1908 (CPC), specifically Section 2(2) (Decree), Section 2(9) (Judgment), Order XIV Rule 1(6), and Order XX Rule 4(2) and Rule 5, concerning the procedural obligations of civil courts, especially in ex parte proceedings. The Appellant (Plaintiff) filed a suit for specific performance of an agreement to sell. The Trial Court dismissed the suit ex parte, finding the Appellant failed to prove the Respondent's (Defendant's) title to the property. The High Court affirmed this decision. (Motor Accident Compensation)

The Motor Vehicles Act, 1988, challenging an award by the Motor Accident Claims Tribunal (MACT), Principal Sub Court, Nagercoil, in MCOP No. 418 of 2007.

The claimant sustained grievous injuries, including a head injury leading to 50% permanent disability, in an accident on 05.12.2006 involving a government bus and a lorry. The claimant alleged negligence on the part of the bus driver.
