(Specific Performance of Sale Agreement)
The Indian Stamp Act, 1899; The Indian Registration Act, 1908 (Sections 17(1A), 49); The Transfer of Property Act, 1882 (Section 53-A); The Specific Relief Act, 1963 (Section 16(c)) - This Second Appeal challenged concurrent judgments decreeing specific performance and permanent injunction based on a sale agreement. The plaintiff (respondent) sued, claiming the defendant (appellant) had agreed to sell property, received a substantial advance of Rs. 4,00,000/- on February 13, 2004, and delivered possession, but later refused to execute the sale deed.
The defendant denied the agreement, alleging forgery, plaintiff's lack of means, and that the unregistered sale agreement (Ex.A.1) was inadmissible under Sections 17(1A) and 49 of the Registration Act, especially when possession was transferred.
