(Maintenance of National Highways, Toll Collection, and Exemptions)
National Highway Fee (Determination of Rates and Collection) Rules, 2008, Rule 11 - Article 226 of the Constitution of India - The petitioner filed a Public Interest Litigation seeking directions for proper maintenance, safety standards, and upgradation of the Kappalur-Uthangudi (Madurai Outer Ring Road) National Highways, commensurate with collected toll charges, to ensure smooth travel.
The petition also sought to prohibit political rallies, religious congregations, and certain commercial constructions near the highway, and to ensure strict implementation against arbitrary toll exemptions for political convoys or private individuals.
Respondents No. 1 and 3, in their counter affidavits, affirmed that the Toll-Operate-Transfer Concessionaire is responsible for highway maintenance, repairs, and preventing encroachments, while adhering to safety standards.
