(Specific Performance of Sale Agreement & Limitation)

Transfer of Property Act, 1882 (Section 53-A); Limitation Act, 1963 (Article 54); Indian Contract Act, 1872 (Section 62) - The appellant, the Official Assignee (5th defendant), challenged a High Court judgment that decreed specific performance of a sale agreement dated 13.12.2006, sought by the respondent-plaintiff, B.V. Reddy Enterprises Pvt. Ltd.

The original owners (Defendants 1 & 2) sold property No.33, College Road, to Defendant 3 (Arjunlal Sunderdas).

(Maintenance of National Highways, Toll Collection, and Exemptions)

National Highway Fee (Determination of Rates and Collection) Rules, 2008, Rule 11 - Article 226 of the Constitution of India - The petitioner filed a Public Interest Litigation seeking directions for proper maintenance, safety standards, and upgradation of the Kappalur-Uthangudi (Madurai Outer Ring Road) National Highways, commensurate with collected toll charges, to ensure smooth travel.

The petition also sought to prohibit political rallies, religious congregations, and certain commercial constructions near the highway, and to ensure strict implementation against arbitrary toll exemptions for political convoys or private individuals.

Respondents No. 1 and 3, in their counter affidavits, affirmed that the Toll-Operate-Transfer Concessionaire is responsible for highway maintenance, repairs, and preventing encroachments, while adhering to safety standards.

(Partition and Declaration of Sale Deeds)

The Indian Evidence Act, 1872 (Sections 68, 69, 71) and the Indian Contract Act, 1872 (Sections 201, 202) - The plaintiff (daughter) sought partition and declaration of sale deeds as null and void, asserting her father died intestate and she was entitled to a 1/4th share. She challenged a sale deed for Item 2, executed by the 5th defendant (Power of Attorney holder) in favor of his wife (4th defendant), contending the POA was extinguished upon her father's demise.

The defendants (sons and transferees) argued that the father executed a Will bequeathing properties to his sons, who then executed a registered partition deed (Ex.B4). They further contended the POA for Item 2 was coupled with consideration and possession, making the subsequent sale valid under Section 202 of the Contract Act, despite the principal's death.

(Appointment of Arbitrator & Enforceability of Restrictive Covenants in Doctor-Hospital Agreements)

The Arbitration and Conciliation Act, 1996 Sections 11(6), 21 - The Indian Contract Act, 1872 Sections 23, 27 - This petition was filed by a hospital under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking to appoint a sole arbitrator to resolve disputes with a consultant doctor. The hospital alleged breaches of a professional agreement, specifically concerning a three-month notice period for termination (Clause 10.2) and a non-compete clause (Clause 8.3).

The hospital claimed Rs. 42 lakhs in liquidated damages, arguing the doctor joined a rival hospital and did not serve the full notice period.

The respondent doctor countered that the non-compete clause was unenforceable, being void under Section 27 of the Indian Contract Act, 1872, and asserted compliance with the notice period.

(Partition, Will, and Inheritance Rights)

This appeal dealt with partition of ancestral and joint family properties, validity of a Will and sale deed, and inheritance under the Hindu Succession Act, 1956 (Sections 8, 15, 16(3)) and Hindu Marriage Act, 1955 (Section 16(3)) - The Court held that Item No.1 property, inherited by A.S. Muthusamy Gounder from his father before the 1956 Act, became ancestral upon the birth of his son, Selvaraj. Items No.2 to 4, purchased by Muthusamy Gounder, were deemed joint family properties, acquired from the substantial income of the ancestral land, as no convincing proof of separate income was presented.

The Will (Ex.B12) executed by Muthusamy Gounder in favour of his grandson (4th defendant), bequeathing his 1/3rd share, was held valid and true.

(Partition of Joint Family Properties and Effect of Sale by Co-owner)

The Hindu Succession Act, Order 41 Rule 27 of the Civil Procedure Code, and Section 3 of the Hindu Gains of Learning Act, 1930. The plaintiff sought partition of inherited properties (A, B, C Schedules), claiming a half share. He alleged that the 1st defendant (elder brother) fraudulently obtained a legal heirship certificate, suppressing the plaintiff’s existence, and sold A & B Schedule properties. The C-Schedule property, jointly mortgaged, was redeemed by the 1st defendant after a court auction. The 1st defendant contended that A & B properties were sold for family debts, and C-Schedule was redeemed solely by him.
