(Appointment of Legal Guardian Across Religious Lines)
The Guardians and Wards Act, 1890 Sections 4(2), 7, 8(a), 10, 17, 47 - This appeal challenged a Family Court's dismissal of a petition seeking appointment of a Hindu couple as legal guardians for a minor Muslim female child. The appellant (husband) and his wife, unable to have children, sought to adopt. The respondent (natural mother), a struggling daily wage labourer and widow, willingly gave her third female child, born on 14.12.2023, to the appellant and his wife for care. The child, named Shri Daanvika, was raised by the appellant couple and recognized them as her parents.
The Family Court dismissed the petition stating that the child was Muslim and the prospective guardians were Hindu and considered "strangers." The High Court found no legal bar under the Guardians and Wards Act, 1890, for such an appointment.
