Trade Marks Act, 1999 – Section 2(1)(zg) and Section 57(2) – This case involves rectification petitions filed by the petitioner, MEDIAMONKS, seeking to cancel the registration of the word mark “MEDIA MONK” and the device mark “MEDIA MONK” with a frog label, owned by the first respondent. The petitioner claimed prior global use of its mark “MEDIAMONKS” since 2001, while the respondent asserted use of “MEDIA MONK” in India since 2009. Industrial Disputes Act, 1947 (ID Act) – Section 2(k), 10(1), 12(5), 18(1), 25F, 25FF, 25L, and 25N – This case concerns a trade union’s challenge to the Appropriate Government’s refusal to refer an industrial dispute for adjudication. The petitioner union, representing sales promotion employees (SPEs) of a pharmaceutical company (respondent 4), contested the retrenchment of over 250 SPEs following the sale of the company’s Human Pharma Division to another entity.

The union argued that the retrenchment violated Section 25N of the ID Act, as the company failed to obtain prior government permission and provide the required notice. They also claimed a breach of a Section 18(1) settlement regarding job security.

Hindu Marriage Act, 1955 – Section 24 – This civil revision petition arose from an order of the Family Court regarding an interim maintenance application filed by the wife in a divorce proceeding initiated by the husband. The wife sought interim maintenance, claiming she was unable to support herself, while the husband, a doctor, argued she was equally qualified and earning well. The Family Court granted a reduced maintenance of Rs. 25,000 per month from the date of filing the interim application, without awarding any litigation expenses.

Industrial Disputes Act, 1947 – Section 2A, 11A, 12(3), 33(1)(b), 33(3) – This case concerns a writ petition filed by five workmen challenging a Labour Court award that denied them reinstatement after their dismissal by the management. The workmen were dismissed for alleged misconduct including participation in an illegal strike, using abusive language, and threatening co-workers. Crucially, no formal inquiry was conducted by the management before the dismissals.

The Labour Court, despite acknowledging the absence of an inquiry, upheld the dismissals based on evidence presented by the management during the Labour Court proceedings.

Indian Penal Code (IPC) – Sections 120B, 420, 465, 468, and 471 – This case involves a Criminal Original Petition filed to quash a final report (C.C.No.288 of 2023) filed against the petitioner, who was accused of offences under Sections 120B (criminal conspiracy), 420 (cheating), 465 (forgery), 468 (forgery for purpose of cheating), and 471 (using as genuine a forged document) of the Indian Penal Code.

The allegations stem from misappropriation within a Trust, where the petitioner worked as a Coordinator in a school run by the Trust. The primary accusation against the petitioner is related to the alleged misappropriation of school funds, where she was responsible for handling fees collected from the students. The prosecution claims that the petitioner conspired with other accused individuals to enable the misappropriation of funds.

Motor Vehicles Act, 1988 – Section 166 – This case involves appeals against the Motor Accident Claims Tribunal’s award regarding a fatal accident. Sabu James, a pillion rider, died after a collision between the motorcycle he was on and an auto. His family claimed compensation, alleging negligence by the auto driver.

The Insurance Company contested the claim, citing a delayed FIR and questioning the accident’s genuineness.
