Jharkhand Superior Judicial Services (Recruitment, Appointment and Condition of Service) Rule, 2001 – Rule 4 and 5 – This appeal arises from a judgment of the High Court of Jharkhand, which declined to quash a notification promoting private respondents to the post of District Judge in the Jharkhand Superior Judicial Service. The appellants, who were senior to the promoted respondents, challenged the promotion process.

The appellants argued that they qualified the suitability test for promotion based on merit-cum-seniority but were denied promotion because they scored lower than others in the merit list. They relied on a Supreme Court judgment that suitability should be tested on individual merit, not comparative assessment.

Tamil Nadu Surveys and Boundaries Act, 1923, Section 9(2) – This Second Appeal contests the concurrent judgments of the First Appellate Court and the Trial Court, which upheld the plaintiffs’ claim for a permanent injunction concerning a property dispute. The plaintiffs asserted ownership through a family arrangement in 1993 and adverse possession, while the defendant claimed ownership via a registered sale deed (Ex-B.1) from a third party, Vaithiyalingam.

The Trial Court, relying on revenue records (Exs-A.2, A.3, A.10, and A.11), decreed the suit in favor of the plaintiffs, granting a permanent injunction. The First Appellate Court upheld this decision.

Tamil Nadu Industrial Establishment (Conferment of Permanent Status) Act, 1981 – Section 3: This Act is a beneficial legislation that mandates permanent status for any workman who has completed 480 days of continuous service in a 24-month period, notwithstanding anything contained in any other law.

Industrial Disputes Act, 1947 – Section 12(3) Settlement vs. Statutory Law: A settlement reached under Section 12(3) of the Industrial Disputes Act cannot override or negate the benefits conferred upon a workman by a special statute like the Tamil Nadu Industrial Establishment (Conferment of Permanent Status) Act, 1981.

Interpretation of Law: The “notwithstanding” clause in a statute signifies that the provision takes precedence over any conflicting laws or agreements, including those made after the statute’s commencement.

The Code of Civil Procedure 1908 (CPC) Section 92; Indian Trust Act – Registered Trust – This case involves a dispute over the trusteeship of the “Congress Ponvizha Mandapam” Trust. The plaintiffs, claiming to be the rightful trustees based on a registered Trust Deed from 1954 and subsequent appointments, filed a suit seeking a declaration of their trusteeship and an injunction against the defendants, who claimed to be appointed by the Congress Committee.

The defendants argued that the plaintiffs should have obtained permission under Section 92 of the Civil Procedure Code (CPC) and that the Trust was under the control of the Congress party. The Trial Court dismissed the suit.

Civil Procedure Code, 1908 (CPC) – Order 7 Rule 11 and Section 100; Limitation Act – Article 59; Transfer of Property Act, 1882 – Section 3; Registration Act – Sections 34 and 35 – This case concerns a suit filed by the appellants for the cancellation of a registered sale deed from 2004, which they allege was fraudulently executed and came to their knowledge only in 2017. The defendants filed an application under Order 7 Rule 11, CPC, seeking rejection of the plaint based on limitation. The Trial Court allowed the application, but the First Appellate Court reversed the decision, holding that the limitation was a mixed question of law and fact that needed evidence.

The High Court, in a second appeal, overturned the First Appellate Court’s decision, stating that the plaintiffs should have known about the sale deed earlier and that they had not provided sufficient details of the alleged fraud.

Arbitration and Conciliation Act, 1996 – Section 11(6); Payment of Wages Act, 1936 – Section 15(2), 22, 23; Industrial Disputes Act, 1947 – Section 2(A) – This case involves an appeal against the High Court of Madras’ decision to appoint an arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996. The appellant argued that the dispute with their employer, M/S Hyundai AutoEver India Pvt. Ltd., falls under the jurisdiction of the Payment of Wages Act, 1936, and the Industrial Disputes Act, 1947, making arbitration inappropriate. The employer filed for arbitration claiming non-payment of wages, legality of termination and violation of a non-disclosure clause.

Indian Penal Code, 1860 (IPC) – Section 498A – Dowry Prohibition Act, 1961 – Sections 3 and 4 – Quashing of proceedings – Girlfriend as relative.  The appellant sought to quash criminal proceedings initiated against her under Sections 498A, 504, 109 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, based on allegations of harassment by the complainant, wife of the appellant’s alleged boyfriend. The High Court had dismissed the petition. The appellant argued that even considering the FIR and charge-sheet, no case under Section 498A IPC was established.

Tamil Nadu Regulation of Rights and Responsibilities of Landlord and Tenants Act, 2017 (TNRRRLT Act) – Section 3, 21(2)(a); Tamil Nadu Minor Inams (Abolition and Conversion into Ryotwari) Act, 1963 – Section 13; Indian Evidence Act, 1872 – Section 116; Bharatiya Sakshya Adhiniyam, 2023 – Section 122 – This revision petition challenges the concurrent orders of the rent appellate authority and rent controller, which directed the eviction of the tenant. The landlord filed for eviction under Section 21(2)(a) of the TNRRRLT Act, 2017, arguing that the tenancy agreement was not registered after the Act came into force. The tenant argued that the land belonged to the HR&CE Department, thus exempting the property from the Act under Section 3(c).

The court noted that the tenant’s induction was undisputed.

Code of Criminal Procedure, 1973 (CrPC) – Section 482 – Indian Penal Code, 1860 (IPC) – Sections 376(2)(n) and 506 – The appellant appealed against a Delhi High Court order that refused to quash an FIR registered against him under Sections 376(2)(n) (rape) and 506 (criminal intimidation) of the IPC. The complainant alleged a forceful sexual relationship under the false promise of marriage, while the appellant claimed it was consensual.

The Supreme Court considered whether the allegations in the FIR and chargesheet constituted offences under Sections 376(2)(n) and 506 IPC. The Court noted the consensual nature of the relationship, the complainant’s continued engagement with the appellant, and the absence of a clear promise of marriage at the outset.

Specific Relief Act 1963 Section 9, 10 & 19 – Agreement to Sell – Proof of Execution and Possession: For a suit seeking specific performance of an agreement to sell, the plaintiff must conclusively prove the execution of the agreement, payment of consideration, and delivery of possession. The High Court can re-evaluate findings if the Trial Court’s conclusions are not supported by sufficient evidence.

Evidence Act, 1872 – Section 101 – Burden of Proof – Fraud and Misrepresentation: The burden of proving fraud or misrepresentation in the execution of an agreement lies squarely on the party alleging it. Failure to lead evidence to support such a claim will result in an adverse inference.
