Transfer of Property Act, 1882 – Section 118 and 54; Registration Act, 1908 – Section 32A.

This appeal arises from the dismissal of a suit filed for declaration and consequential injunction regarding a property originally purchased in a court auction by Panchalai Ammal. The plaintiff claimed ownership based on an exchange deed dated 10.08.2009 with Adhiyammal (daughter of Panchalai Ammal) and her daughter Vijaya. The defendants, relatives of Adhiyammal, contested the exchange deed, alleging fabrication and questioning the validity of a related Will and adoption.

The trial court dismissed the suit, doubting the genuineness of the exchange deed due to unequal property values and failure to prove the adoption and Will.

Negotiable Instruments Act, 1881 (NI Act) – Section 138 and 141 and Code of Criminal Procedure, 1973 (CrPC) – Section 482 – The appeal arises from a High Court judgment dismissing petitions under Section 482 CrPC, which sought to quash criminal proceedings initiated under Section 138 read with Section 141 of the NI Act. The appellant, an independent non-executive director of a company, was implicated in complaints regarding dishonored cheques issued by the company.

The appellant argued that, as a non-executive director, he had no role in the financial operations or key management of the company, and he neither signed nor authorized the issuance of the dishonored cheques. Furthermore, he had resigned before some of the complaints were filed.

Code of Criminal Procedure, 1973 (CrPC) – Section 50, Article 22(1) of the Constitution of India and Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) – Section 47 – This case concerns the arrest of the appellant in connection with an FIR registered under Sections 409, 420, 467, 468, 471, and 120-B of the Indian Penal Code (IPC). The appellant argued that his arrest was illegal due to violations of Article 22(1) of the Constitution of India and Section 50 of CrPC, specifically that he was not informed of the grounds for his arrest.

The Supreme Court examined the requirements of Article 22(1), emphasizing that informing an arrested person of the grounds for their arrest is a mandatory constitutional right. This information must be communicated effectively in a language the arrestee understands, ensuring they can meaningfully exercise their right to consult legal counsel.

Prevention of Corruption Act, 1988 – Sections 7, 13(2) read with Section 13(1)(d); Indian Penal Code, 1860 – Section 34; Airport Authority of India Employees (CDA) Regulations, 2003 – This case involves an appeal against a judgment of the Calcutta High Court’s Division Bench, which had overturned a Single Judge’s order upholding the dismissal of an Assistant Engineer (the respondent) from the Airport Authority of India (the appellant-Authority). The respondent was initially convicted by a CBI court for corruption, leading to his dismissal. However, the High Court later acquitted him based on benefit of doubt in a criminal appeal.

Despite the acquittal, the appellant-Authority initiated fresh disciplinary proceedings, eventually leading to the respondent’s dismissal again.

Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 – Section 3(22), 20, 37-A and 83 – These Civil Revision Petitions challenge the orders passed by the Agricultural Land Tribunal (District Revenue Officer), Tuticorin, confirming the order of the Assistant Commissioner (Land Reforms), Tirunelveli, regarding the acquisition of land held by SPIC (Southern Petrochemical Industries Corporation Limited) and transferred to Tuticorin Alkali Chemicals and Fertilizers Limited (TAC).

The core issue revolves around the exemption of land under Section 37-A of the Act for industrial or commercial undertakings. SPIC acquired lands, including government “poramboke” lands, for establishing a fertilizer manufacturing complex. Subsequently, SPIC transferred portions of these lands to TAC, BARC, and TNEB.

• Criminal Procedure Code, 1973 (Cr.P.C.) – Section 133(1)(b) – Public Nuisance – Dog Breeding Centre / Keeping of Dogs: For an order under Section 133(1)(b) Cr.P.C. to be sustained for nuisance caused by keeping dogs, two conditions must be met: (1) the keeping of dogs must be pursuant to a trade or occupation, and (2) it must be injurious to the health or physical comfort of the community. While the second condition (nuisance) can be established, the first condition (trade or occupation) must be specifically proven and cannot be merely presumed from past activity or number of dogs without proper inquiry and evidence.
• Cr.P.C. – Section 133 – Procedural Compliance – Natural Justice: While strict adherence to the preliminary order procedure under Section 133 Cr.P.C.

Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 Sections 13 and 14 –  This writ petition was filed seeking a mandamus to direct the Inspector of the Tamil Nadu Hindu Religious and Charitable Endowment Department to submit a fresh report to the Joint Commissioner, regarding O.A.No.30/2023, after conducting a proper inquiry as per the Act. The petitioner, a trustee of Arulmighu Thangavinayagar Temple, claimed hereditary trusteeship and contested the notice for appointing non-hereditary trustees.

The court examined Section 63 of the Act, which outlines the powers of the Joint Commissioner or Deputy Commissioner to inquire into and decide disputes, including whether a trustee holds hereditary office. It also analyzed Sections 13 and 14 concerning delegation of powers, as well as the Delegation of Powers Rules.

Industrial Disputes Act, 1947 Section 2(k); Trade Uniona Act 1926 Section 2(h) –  The case originated from a dispute between Nithya Packaging Private Limited (Management) and its workmen, who formed a trade union. The workmen alleged unfair labour practices, including refusal of employment and wage payment after forming the union. Conciliation failed, leading to adjudication by the Labour Court, Puducherry, which ordered reinstatement of 25 workmen with back wages.

The Management challenged the award, arguing that some workmen were contract labourers, a settlement was reached with several workmen, and the union was unregistered at the dispute’s inception.

Industrial Disputes Act, 1947 (and related Labour Laws) – This case involves an appeal by a Trade Union against the dismissal of its Writ Petition. The Trade Union sought a directive preventing Tamil Nadu State Transport Corporations from negotiating with other unions during its recognition period, arguing it was the majority union and should have exclusive representation rights.

The appellant argued that allowing management to negotiate with unions lacking majority support would undermine collective bargaining principles. The respondents, including other Trade Unions, contended that recognition shouldn’t grant exclusive representation, as worker support fluctuates, especially given political affiliations of unions.

• Adverse Possession – Requisites and Proof: The plea of adverse possession is a blended question of fact and law. To succeed, the claimant must prove that their possession was (without force, without secrecy, and without permission), continuous, open, and hostile to the true owner for the statutory period of 12 years. The mere fact of long possession, mutation of revenue records, or custody of original title deeds is not sufficient to establish adverse possession.
• Permissive Possession: Permissive possession, even if it is for a long duration, can never mature into adverse possession. The (intention to possess as owner) must be openly and clearly asserted against the true owner.
• Limitation Act, 1963 – Articles 64 & 65: The limitation period for a suit for possession of immovable property based on title is 12 years from the date the possession of the defendant becomes adverse to the plaintiff.
