Arbitration and Conciliation Act, 1996 Section 34 and 74 & Civil Procedure Code, 1908 (CPC) Order 7 Rule 11 and Section 151 – This judgment concerns appeals against the rejection of a plaint in O.S. • Criminal Procedure Code, 1973 (Cr.P.C.) – Section 156(3): Magistrate’s power to direct police investigation. A Magistrate must apply mind to ascertain if allegations disclose a cognizable offence; mechanical order is impermissible.
• Indian Penal Code (IPC) – Section 294 (Obscene acts and songs): Mere abusive, humiliating, or defamatory words, without lascivious elements arousing sexual thoughts, do not constitute an offence under Section 294 IPC. Annoyance to others must also be proven.
• Indian Penal Code (IPC) – Sections 504 (Intentional insult to provoke breach of peace) & 506 (Criminal Intimidation): Mere abuse may not fall under Section 504; the insult must be intended or likely to provoke a breach of public peace or another offence. For Section 506, a genuine threat causing alarm is required.
• Misuse of Legal Process: Courts emphasize curbing frivolous and vexatious litigation, especially under Section 156(3) Cr.P.C., to prevent harassment.

BNSS 2023 – Procedural Safeguards: Section 175(3) of BNSS codifies judicial precedents, mandating prior application to Superintendent of Police (with affidavit) and requiring Magistrate to conduct inquiry and consider police submissions before ordering investigation.

Arbitration and Conciliation Act, 1996 – Section 31(7), 33 – This case concerns a dispute arising from a construction contract awarded by the North Delhi Municipal Corporation (appellant) to M/s. S A Builders Ltd (respondent). The dispute went to arbitration, and the arbitrator passed an award in favor of the respondent.

Key Issue: Whether the arbitrator had the jurisdiction to issue a clarification to the award several years after the original award was passed, and the interpretation of Section 31(7) of the Arbitration and Conciliation Act, 1996 regarding interest calculations.
