Specific Relief Act, 1963 – Sections 31 and 34 – Suit for declaration of title based on Gift Deed – Necessity of seeking cancellation of subsequent sale deed – The core issue revolves around whether a plaintiff, claiming title to property based on a valid Gift Deed, is required to seek the cancellation of a subsequent sale deed to which they were not a party, in order to obtain a declaration of their title.

The court emphasizes that Section 31 applies to parties to the instrument or those claiming through them.

The Civil Procedure Code, 1908 (CPC) Order VII Rule 11: The Copyright Act, 1957 Section 15(2) - This case concerns a dispute over alleged copyright infringement related to the design and manufacture of internal parts for Cryogenic Storage Tanks. Inox India Limited (Inox) filed a suit against Cryogas Equipment Private Limited (Cryogas) and LNG Express India Private Limited (LNG Express), claiming infringement of their Proprietary Engineering Drawings and Literary Works. LNG Express filed an application under Order VII Rule 11 of the Civil Procedure Code, 1908 (CPC) seeking rejection of the suit, arguing that the drawings were registrable designs under the Designs Act, 2000 and had been reproduced more than fifty times, thus losing copyright protection under Section 15(2) of the Copyright Act, 1957.

The Commercial Court initially allowed the application and rejected Inox’s plaint, but the High Court set aside the order, restoring the suit.

Maintenance and Welfare of Parents and Senior Citizens Act, 2007 – Section 23 – The case involves a senior citizen who filed a complaint seeking to nullify a settlement deed executed in favor of his son (the appellant), claiming fraud and coercion. The senior citizen alleged neglect after the deed’s execution. The appellant contended the deed was voluntary and offered maintenance. The Revenue Divisional Officer (RDO) ordered maintenance payment, but the senior citizen appealed, and the District Collector upheld the RDO’s order.

Code of Criminal Procedure, 1973 (CrPC) – Sections 402, 482, 227 and Indian Penal Code (IPC) – Sections 376, 417, 506 – This case involves an appeal against the Calcutta High Court’s order, which refused to discharge the appellant, a former judicial officer, in a case registered under Sections 376 (rape), 417 (cheating), and 506 (criminal intimidation) of the IPC. The FIR was filed by the Respondent, who alleged that the Appellant had physical relations with her under the false promise of marriage.

The Complainant stated that the Appellant, assured her that he would marry her after her divorce, maintained her in a rented house, and financially supported her and her son. However, after her divorce, he allegedly avoided her.

Code of Civil Procedure, 1908 (CPC) – Order 7 Rule 11 – Rejection of Plaint – Suit for partition filed after a considerable delay, challenging a family partition that occurred in 1968 and registered sale deeds executed in 1978. Defendants filed an application under Order 7 Rule 11 CPC seeking rejection of the plaint, arguing the suit was barred by limitation and lacked a cause of action. The Trial Court allowed the application, but the appellate court reversed, remanding the matter for fresh consideration, stating triable issues existed.

The plaintiffs failed to specify when they became aware of the registered sale deeds, and the partition took place 55 years before the suit was filed.

Industrial Disputes Act, 1947 – Section 33C(2): A Labour Court’s jurisdiction under this section is for computing a pre-existing right. It cannot be used to adjudicate a disputed claim where the employer-employee relationship is over and the right itself is contested on merits, such as deductions for losses.

Payment of Wages Act, 1936 – Section 7(2)(c): This section permits an employer to make deductions from an employee’s wages for damage or loss of goods directly attributable to their neglect or default.

Service Law – Recovery of Losses after Retirement: While disciplinary proceedings to impose a penalty may not be initiated or continued after an employee’s retirement without a specific enabling rule, the recovery of losses caused by the employee to the organization is permissible, especially if the employee has given a written undertaking for such a deduction.

Karnataka Civil Services (General Recruitment) Rules, 1977 – Rule 16 & Karnataka Government Servants (Seniority) Rules, 1957 – Rule 6 – The core issue revolves around whether a government employee’s transfer or reappointment impacts seniority in the new post, specifically when the transfer is due to medical reasons and at the employee’s request. The court emphasizes that administrative rules govern the relationship between the state and its employees.

The respondent, initially a Staff Nurse, requested a cadre change to First Division Assistant due to medical reasons. The government approved the request, and the respondent consented to be placed below the last person in the transferred post.

The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 – Section 23(1) – The case revolves around the cancellation of a Settlement Deed executed by a senior citizen (Smt. S. Nagalakshmi) in favor of her son, who is now deceased. The senior citizen, aged 87, filed an application under the Senior Citizens Act, stating that she was neglected by her son and daughter-in-law after her son’s death, despite settling the property with the expectation of being cared for.

The Protection of Women from Domestic Violence Act, 2005 – Sections 12, 18, 19, 22, and 28; Criminal Procedure Code (Cr.P.C) – Section 391; Civil Procedure Code (C.P.C) – Order 7 Rule 14(3) and Section 151 – This civil revision petition arises from a case filed under the Protection of Women from Domestic Violence Act, 2005 (DV Act) where the wife sought reliefs including protection, maintenance, and compensation. The trial court ruled in favor of the wife, directing protection and ordering the husband and father-in-law to pay monthly maintenance and a substantial compensation.

The husband and father-in-law appealed, seeking to introduce additional evidence. The High Court allowed their petition, directing the appellate court to permit them to present evidence and cross-examine the wife.

Civil Procedure Code (CPC) 1908 Order 22 Rule 3, 4, And 9 – Substitution and Abatement: A suit or appeal does not automatically abate upon the death of a party if the right to sue survives. However, it will abate if an application to substitute the legal representatives of the deceased party is not filed within the prescribed 90-day limitation period under Article 120 of the Limitation Act, 1963.

Limitation Act – Condonation of Delay: The proper sequence for rectifying an abatement is as follows:

1. 1. An application for substitution must be filed within 90 days of a party’s death.
   2. If this is not done, the suit/appeal abates. An application to set aside this abatement must then be filed within the next 60 days (Article 121).
   3. If this 60-day window is also missed, a separate application for condonation of delay under Section 5 of the Limitation Act must be filed specifically for the delay in filing the application to set aside abatement.
