Transfer of Property Act, 1882 – Section 52 – Lis Pendens & Limitation Act, 1963 – Article 58, 59 & 65 – Suit for Cancellation of Sale Deeds, Recovery of Possession and Injunction – The appeal challenges the High Court’s dismissal of a second appeal, which had overturned the trial court’s dismissal of a suit for cancellation of sale deeds, recovery of possession, and injunction. The core issue revolves around the validity of sale deeds executed by a family member (Ramesh Chand) lacking clear title to the property, in favour of the appellants, during the pendency of another suit.
The court must decide if the suit is barred by limitation, if the sale deeds were void, if the WILL stood admitted and if the first appellate court was right in decreeing the suit without the plaintiffs seeking relief of declaration/cancellation
The Supreme Court held that the suit was barred by limitation under Article 58 & 59 of the Limitation Act, 1963, as the plaintiffs failed to initiate proceedings within three years of gaining knowledge of the sale deeds. Additionally, the Court found the sale deeds not void ab initio and, because title could not be traced through the WILL, the first appellate court erred in granting a decree for recovery of possession without a declaration of rights.
