Motor Vehicles Act, 1988 – This Civil Miscellaneous Appeal was filed by the insurance company, challenging the award passed by the Motor Accident Claims Tribunal in MCOP No.194 of 2004. The case originated from a road accident where a bus collided with a lorry resulting in the death of a person travelling in the lorry.

The claimants alleged rash and negligent driving by the bus driver, whereas the insurance company contended that the deceased was an unauthorized passenger in a goods vehicle. The Tribunal held both the Transport Corporation (bus) and the owner/insurer of the lorry jointly liable for compensation.

Motor Vehicles Act, 1988 – Section 166, 167(5); Indian Succession Act, 1925 – Section 306 – This appeal was filed by the original claimant, who sustained injuries in a motor accident and later died, seeking enhanced compensation. The insurance company objected to the continuation of the appeal by the legal representatives, citing Section 306 of the Indian Succession Act, 1925, arguing that claims for personal injury abate upon the claimant’s death.

The court considered Section 167(5) of the Motor Vehicles Act, 1988, which explicitly states that the right to claim compensation for injury in an accident survives to the legal representatives, regardless of the cause of death. The court also considered the previous judgements of the Hon’ble Supreme Court, which held that even after the death of the injured, the legal representatives of the deceased can pursue the claim since the property under the Act would have a much wider connotation than the conventional definition and would include the estate left behind by the deceased.

Criminal Procedure Code, 1973 (Cr.P.C.) – Section 482 and Indian Penal Code, 1860 (IPC) – Section 307 – Quashing of proceedings – Settlement between parties – The primary issue was regarding the High Court’s refusal to quash proceedings under Section 482 Cr.P.C., citing the presence of Section 307 IPC, despite a compromise between the parties. The High Court had erroneously focused on compounding instead of quashing, overlooking the broader considerations for justice.

The Supreme Court clarified the distinction between compounding and quashing. The court highlighted that the mere mention of Section 307 IPC does not automatically preclude quashing, especially when the underlying dispute is predominantly private and the societal impact is minimal.

Criminal Procedure Code, 1973 (Cr.P.C.) – Section 438 & Indian Penal Code (IPC) – Sections 376 and 50 – This appeal contests the Kerala High Court’s order dated 24.09.2024, which rejected the appellant’s request for anticipatory bail under Section 438 of the Cr.P.C. The appellant is accused in Crime No. 1192 of 2024, registered at the Museum Police Station, Thiruvananthapuram, for offences under Sections 376 (rape) and 506 (criminal intimidation) of the IPC.

The Supreme Court considered the arguments of both parties and reviewed the case documents.

• Criminal Procedure Code, 1973 (Cr.PC) – Section 482 – Quashing of Criminal Proceedings – Commercial Dispute vs. Criminality: While settlement of a civil dispute (loan repayment) can be a factor for quashing, it’s not an absolute bar, especially when serious non-compoundable offenses like forgery (Sections 467, 468, 471 IPC) are alleged and criminal conspiracy is established through evidence of bogus firms and diversion of funds.
• Indian Penal Code, 1860 (IPC) – Sections 120-B, 420, 467, 468, 471 – Cheating, Forgery, Criminal Conspiracy: Mere repayment of a loan after accounts turn NPA does not automatically negate criminal charges, particularly when evidence points to a well-planned conspiracy involving the creation of fictitious firms and forged documents for siphoning funds, indicating a deeper criminal intent beyond a simple breach of contract.
• Role of Family Members in Business – Presumption of Innocence vs. Overt Acts: A defense claiming family members (wife, daughter, son) were mere “name lenders” or acted under the deceased family head’s direction requires proof; specific overt acts, such as signing documents for bogus transactions or being a proprietor of an entity involved in fraud, indicate active participation and cannot be dismissed solely based on familial relations.
• Stage of Proceedings – Quashing at Advanced Stage of Trial: High Courts should exercise their inherent powers under Section 482 Cr.PC sparingly, especially when the trial is at an advanced stage (prosecution evidence complete, 313 Cr.PC statements recorded, defense witness examined, and arguments concluded), as the trial court is best placed to appreciate evidence and deliver a judgment on merits.
• Role of Directors/Proprietors – Familial Relationship as Defense: Claims by family members (wife, daughter, son) of being “name lenders” or merely following directions of the deceased head of the family, while relevant for defense, cannot be used to quash proceedings at an advanced stage, particularly when evidence suggests their involvement in transactions leading to the alleged offenses.

Final Decision:    The Criminal Original Petitions seeking to quash the proceedings are dismissed. The court declined to interfere under Section 482 Cr.P.C.

Income Tax Act, 1961 – Sections 68, 115BBE, 133(6), 142(1), 143(2), 143(3) – Assessment Year 2017-2018 – Writ Petition challenging assessment order under Section 143(3) – Violation of principles of natural justice – Addition of unexplained cash credit.

The petitioner, a Non-Banking Financial Company (NBFC), challenged an assessment order under Section 143(3) of the Income Tax Act, 1961, arguing a violation of natural justice and an incorrect application of Section 115BBE.

The Assessing Officer added Rs. 99,50,749 as unexplained cash credit under Section 68, noting discrepancies in cash deposits made during demonetization.

Micro, Small and Medium Enterprises Development Act, 2006 (MSMED Act) Section 9 – These writ petitions were filed challenging sale notices issued by Canara Bank, arguing that the bank failed to comply with the framework for revival and rehabilitation of Micro, Small and Medium Enterprises (MSMEs) as mandated by the MSMED Act, 2006, and related RBI guidelines. The petitioners, all MSME units, claimed that their loan accounts were declared Non-Performing Assets (NPA) and faced recovery actions under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) without proper consideration for revival schemes.

The bank argued that the petitioners didn’t initially disclose their MSME status and that earlier writ petitions on similar issues were dismissed. The court rejected the bank’s arguments, emphasizing that the MSME status was evident in loan documents and that the bank failed to form a committee as required by the RBI’s framework for stressed MSMEs.

Tamil Nadu Public Buildings (Licensing) Act, 1965 and Rules, 1966, specifically clause (6) substituting Rule 11 and clause (9) omitting Rule 12-A – The writ petition was filed by registered engineers challenging G.O.Ms.No.89, dated 27.05.2025, which amended the Tamil Nadu Public Buildings (Licensing) Rules, 1966, specifically clause (6) substituting Rule 11 and clause (9) omitting Rule 12-A.

The amendments broadened the qualifications for certifying the safety of public buildings to include faculty members of civil engineering departments with specified experience and removed the prescribed fee for engineers issuing structural soundness certificates.

The petitioners argued that the amendments were arbitrary, lowered safety standards, encouraged unhealthy competition, and conflicted with the National Building Code and the Tamil Nadu Combined Development and Building Rules, 2019.

The court analyzed the provisions of the Tamil Nadu Public Buildings (Licensing) Act, 1965, the amended rules, and relevant case laws, including Avinash Mehrotra Vs.

Prevention of Money Laundering Act, 2002 (PML Act) – Section 19 – Power of Arrest and Safeguards – Section 19 of the PML Act, governing the power to arrest, is stringent and includes preconditions that act as vital safeguards for individual liberty: (i) the authorized officer must possess material; (ii) based on this material, the officer must form and record in writing “reasons to believe” that the person is guilty of a PML Act offense; and (iii) the arrested person must be informed of the grounds for arrest as soon as possible. These safeguards ensure fairness, objectivity, and accountability.

Prevention of Money Laundering Act, 2002 (PML Act) – Section 19(1) & Article 22(1) of Constitution of India – Grounds of Arrest and Fundamental Rights – The requirement to inform the arrested person of the grounds for arrest is a fundamental right under Article 22(1) of the Constitution and serves a crucial purpose: enabling the arrested person to effectively seek bail under Section 45 of the PML Act by understanding the basis of their arrest and the officer’s “reason to believe” their guilt. Any infringement of this right vitiates the arrest and subsequent remand.

Payment of Gratuity Act, 1972 – Section 4(6), 13; Code of Civil Procedure, 1908 – Section 60(1)(g); Order 39 Rule 1 & 2, Section 151 – This revision petition challenges the trial court’s order directing the plaintiffs (respondents 1 and 2) to deposit Rs.6,75,000/- (gratuity amount) into the court and restraining the third respondent (second defendant/Authority under the Payment of Gratuity Act) from disbursing the amount to the revision petitioner (first defendant/employee). The plaintiffs filed a suit to recover dues from the revision petitioner, their former employee, alleging unsubmitted or untallied travel expense accounts. The revision petitioner claimed gratuity under the Payment of Gratuity Act, which the plaintiffs contested, citing outstanding dues.

The court noted that no disciplinary proceedings were initiated against the revision petitioner to quantify the alleged loss to the company due to his actions.
