(Arbitration and Interim Measures)
This appeal concerns the interpretation of "commencement of arbitral proceedings" under the Arbitration and Conciliation Act, 1996 (the 'Act'), specifically Sections 9, 21, and 43(2), and Rule 9(4) of the Arbitration (Proceedings Before the Courts) Rules, 2001 (the '2001 Rules'). The case also involves Order 39 Rules 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908.
The Appellant, Regenta Hotels Private Limited, sought an interim injunction under Section 9 of the Act against Respondent No.2, a partner in M/s Hotel Grand Centre Point, due to alleged interference in hotel operations under a Franchise Agreement dated 23.03.2019.
The Trial Court dismissed the interim injunction, partly on grounds that the Appellant failed to prove Respondent No.2's consent to the agreement and did not initiate arbitration within 90 days.
