Misbranding of Food Articles – The Supreme Court upheld the concurrent findings of conviction for misbranding of sugar-boiled confectioneries. The misbranding was due to the absence of the complete manufacturer’s address and the date of manufacturing on the packets, a violation of Rule 32(c) and (f) of the Prevention of Food Adulteration Rules, 1955, as applicable at the time of the offense (2000).
Applicability of Amended Rules – The Court rejected the appellant’s contention regarding the non-applicability of Rule 32(c) and (f), confirming that these were indeed the correct provisions in force on the date of the offense.
Benefit of Lesser Punishment under Subsequent Legislation (Article 20(1) and Beneficial Construction) – Applied the principle of beneficial construction of criminal legislation.
