(Motor Vehicle Accident Claim - Two-wheeler Bundled Policy Interpretation)

This case primarily involves the interpretation of insurance liability under a Two-wheeler Bundled Policy in light of the Motor Vehicles Act, 1988.

The appellant, an insurance company, appealed against a Motor Accident Claims Tribunal (MACT) judgment awarding compensation for the death of a pillion rider in a motor vehicle accident. The accident occurred on 06.02.2021. The deceased, Srinath, was a pillion rider on a Bajaj Pulsar. The claimants, Srinath's parents, sought compensation, alleging rash and negligent driving by the vehicle's driver.

Tamil Nadu Land Encroachment Act, 1905 – Sections 6, 7, 10, 10-A. Revenue Standing Order (RSO) 26(15) – This writ petition challenged a government order rejecting a revision against an eviction notice. The petitioner’s land included a “plan-marked channel,” which RSO 26(15) defines as government land, despite running through private patta land. Authorities discovered the petitioner had laid a 63-foot pipeline and constructed a 7-foot wall within this channel, significantly obstructing the free flow of water.

Motor Vehicles Act, 1988 (MV Act) – Section 2(30); Representation of the People Act, 1950 – Section 160 – This appeal addressed the shifting of liability for an accident involving a bus, requisitioned by the appellant (a state functionary) for Gram Panchayat Elections, which resulted in a fatality. The High Court had increased the compensation to Rs. 27,01,556/- and held the appellant liable, overturning the Motor Accident Claims Tribunal’s initial fastening of liability on the insurance company.

The Supreme Court examined whether the requisitioning authority or the insurance company should bear the burden.

(Motor Accident Claim - Compensation Appeal)

The Motor Vehicles Act, 1988 - The claimants (husband and children) sought compensation for the death of the deceased, a 54-year-old tailoring teacher. The accident occurred on 21.08.2020 when she was a pillion rider on a two-wheeler that was struck by a car driven negligently. The Tribunal found the car driver responsible and awarded Rs. 56,78,684/- with interest at 7.25% per annum.

Indian Penal Code, 1860 (IPC) – Sections 294(b), 417, 506(i). Code of Criminal Procedure, 1973 (Cr.P.C.) – Sections 437, 438 – The petitioner was arrested for offences including sexual intercourse on a false promise of marriage and criminal intimidation, later granted bail. Initially, bail conditions included daily police reporting. Subsequently, the Principal District and Sessions Judge modified these conditions, requiring the petitioner to surrender his passport and obtain prior court permission to leave India.

The Civil Procedure Code, 1908 (CPC) Section 96 read with Order XLI Rules 1 and 2 – The Registration Act Section 49 – The plaintiff filed an Appeal Suit under Section 96 read with Order XLI Rules 1 and 2 of the Civil Procedure Code, 1908 (CPC), challenging the Trial Court’s dismissal of their specific performance suit. The plaintiff sought specific performance of a Sale Agreement (Ex.A-1) dated July 24, 2014, for the sale of property at Rs.14,00,000/-, having paid an advance of Rs.3,00,000/-.

The first defendant contended that Ex.A-1 was merely a security for a Rs.3,00,000/- loan, denying any intent to sell the property. The Trial Court concluded that the agreement was for loan security and denied specific performance, granting an alternate relief of refund with interest.

Indian Penal Code, 1860 (IPC) – Sections 417, 498A, 506(i). Hindu Marriage Act, 1955 – This criminal original petition aimed to quash proceedings in C.C. No. 143 of 2022, where the petitioners were accused of offences including cheating (Section 417 IPC), cruelty by husband or relatives (Section 498A IPC), and criminal intimidation (Section 506(i) IPC).

Motor Vehicles Act, 1988 (M.V. Act) – Section 133, 149(2)(a)(ii); Indian Evidence Act, 1872 – Section 114; Tamil Nadu Motor Vehicles Rules, 1989 – Rule 376 – This Civil Miscellaneous Appeal challenged a Motor Accidents Claims Tribunal award. The petitioner, a pillion rider, sustained injuries due to the motorcycle driver’s negligence, who later died. The owner was ex-parte.

Indian Penal Code, 1860 (IPC) – Sections 498A, 304B, and Indian Evidence Act, 1872 – Section 113B – This criminal appeal challenged the conviction of the appellant (husband) under Section 498A IPC by the Trial Court. The appellant was initially charged under Sections 498A and 304B IPC following his wife’s death by hanging, which occurred within seven years of marriage. The prosecution alleged dowry demands, alcohol consumption, and quarrels leading to harassment.

The Trial Court acquitted the appellant of dowry death (Section 304B IPC) and also acquitted all other accused, finding no specific evidence of dowry demand.

(Specific Performance of Sale Agreement)

The Code of Civil Procedure, 1908, Order 41 Rule 22 - The Indian Contract Act, 1872, Section 10 - The Limitation Act, 1963, Article 54 - The Specific Relief Act, 1963 - This second appeal arose from a suit for specific performance of a sale agreement dated 10.06.1990. The plaintiff contended that the defendant received full consideration (Rs. 23,500/-) and handed over property possession, but later refused to execute the sale deed. The defendant denied the agreement, claiming forgery and asserting the suit was time-barred.
