Criminal Procedure Code, 1973 (CrPC) – Section 438 – Anticipatory Bail – Maintainability while in Judicial Custody for a Different Offence

An application for anticipatory bail under Section 438 CrPC is maintainable even if the accused is already in judicial custody in connection with a different case. The precondition for anticipatory bail is a “reason to believe that he may be arrested,” which can exist for a different, apprehension of arrest in a new case while already in custody in another. The object of anticipatory bail is to protect personal liberty and prevent humiliation of arrest, and this right cannot be curtailed without a clear statutory bar. The fact that an accused is in custody in one case does not mean they cannot apprehend arrest in another. Conditions of anticipatory bail, such as making oneself available for interrogation, would become effective upon release from prior custody and subsequent arrest in the new case.

• Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) – Section 67 – Admissibility of Confessional Statement: A statement recorded under Section 67 of the NDPS Act is inadmissible as a confessional statement in the trial of an offence under the NDPS Act, as officers invested with powers under Section 53 of the NDPS Act are “police officers” within the meaning of Section 25 of the Evidence Act.
• NDPS Act – Sections 22(c) and 29 – Proof of Offence – Conspiracy: To convict an accused for transporting or possessing commercial quantity of psychotropic substance (Section 22(c)) when the actual transportation is done by another, or for criminal conspiracy (Section 29), the prosecution must establish through admissible evidence that the accused supplied the contraband or was a party to a criminal conspiracy. Mere suspicion or inadmissible evidence is insufficient for conviction.
• Criminal Procedure Code, 1973 (CrPC) – Section 313 – Examination of Accused – Prejudice: While non-framing of a specific charge may be a ground for challenging conviction, it becomes secondary if there is a complete lack of admissible legal evidence to prove the alleged offences beyond a reasonable doubt against the accused.

Final Decision:   The Supreme Court allowed the appeal, setting aside the conviction of the appellant under Sections 22(c) and 29 of the NDPS Act. The Court found no admissible legal evidence to prove that the appellant supplied the contraband or was part of a criminal conspiracy, as the reliance on the inadmissible statement under Section 67 of the NDPS Act and the absence of crucial prosecution witnesses rendered the case unproven beyond a reasonable doubt.

Prevention of Corruption Act, 1988 (PC Act) – Sections 7, 13(1)(d) read with 13(2) – Bribery – Demand and Acceptance of Illegal Gratification – Circumstantial Evidence – Role of Shadow Witness – Credibility of Interested Witness – Duty of Trap Laying Officer (TLO)

Proof of demand and acceptance of illegal gratification is a sine qua non for establishing guilt under Sections 7 and 13(1)(d) read with 13(2) of the PC Act. While this can be proven by direct or circumstantial evidence, the TLO has a duty to verify the demand of bribe before organizing a trap, particularly by recording conversations or deploying independent shadow witnesses. The testimony of an interested witness, such as a close friend of the complainant, needs careful scrutiny and corroboration. A crucial admission made by the complainant during cross-examination, especially regarding handling of the bag where tainted money was found, cannot be cursorily dismissed as an afterthought if not re-examined by the prosecution.

Criminal Procedure Code, 1973 – Section 439 – Bail – Grant and Cancellation – Murder and Attempted Murder The High Court’s orders granting bail to accused persons in a double murder case were perverse and unreasoned, as they failed to consider crucial factors such as the gravity of the offense, the specific roles attributed to the accused by eyewitnesses, and their criminal antecedents. The High Court also erred by granting bail based on parity with an earlier bail order that had been set aside by the Supreme Court. Bail orders must reflect due application of judicial mind, considering the seriousness of the crime, potential for witness tampering, and risk of the accused absconding.

Criminal Procedure Code, 1973 – Section 149 – Common Object – Unlawful Assembly In cases where accused persons are part of an unlawful assembly and charged under Section 149 IPC, the individual role of each accused does not need to be meticulously examined at the bail stage if there is a prima facie case of their involvement in the common object leading to serious offenses.

Indian Penal Code (IPC), 1860 – Section 306 & 498A, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 – Section 3(1)(x) – Appeal contests the judgment of the Principal Sessions Judge, Tiruppur, in Special S.C.No.6 of 2015, convicting the appellant for offenses under Section 306 IPC (abetment to suicide), Section 498A IPC (cruelty to wife), and Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Ordinance, 2014.

The case involves a love affair and subsequent marriage between the appellant (Backward Class) and the deceased (Scheduled Caste). The prosecution argued that the appellant subjected the deceased to caste-based abuse and cruelty, leading to her self-immolation. The defense countered that the deceased suffered from mental health issues and the accusations were fabricated due to the family’s disapproval of the marriage.

Workmen’s Compensation Act, 1923 – Section 3(1)(b)(ii) – The Insurance Company filed an appeal challenging the compensation awarded to the claimants by the Commissioner for Workmen’s Compensation, Madurai. The claimants sought compensation for the death of the deceased, who was fatally injured while working as a loadman on a tractor owned by the sixth respondent due to the driver’s rash driving.

The Insurance Company argued that the deceased was an unauthorized passenger and therefore, the insurance policy did not cover the claim. The Commissioner ruled in favour of the claimants, holding the owner liable and the Insurance Company responsible for indemnification.

Industrial Disputes Act, 1947 – Section 18(1), 33, 33C(2) – The writ petition challenges the Labour Court’s order partly allowing the computation petitions filed by nine workmen, seeking salary and benefits for the period of their alleged illegal dismissal. The workmen claimed that the management, in violation of Section 18(1) settlement and during the pendency of an industrial dispute, illegally terminated their services with retrospective effect without seeking prior permission or approval as mandated under Section 33 of the Industrial Disputes Act, 1947.

The management argued that the termination was a “termination simpliciter” due to the mill’s temporary suspension and did not attract Section 33, further contending that the workmen should have challenged the termination separately instead of directly filing computation petitions under Section 33C(2).

The Labour Court ruled in favor of the workmen, holding that the management violated Section 33(2)(b) of the Act.

(Anticipatory Bail in Politically Charged Defamation Case)

Bharatiya Nyaya Sanhita, 2023 (BNS): Sections 175, 3(5), 3(6), 318, 336(4), 337, 338, 340, 341(1), 351(1), 352, 353, 356, and 61(2) - This appeal challenged the Gauhati High Court's refusal of anticipatory bail to the Appellant, a national political party office-bearer, in connection with FIR No. 04/2026. The FIR alleged that the Appellant, during press conferences, displayed purportedly forged documents claiming the complainant (wife of the Chief Minister of Assam) held multiple passports and undisclosed assets, intending to defame her and influence state elections.

The Appellant contended that the statements were politically motivated, most alleged offences were bailable, and he did not fabricate the documents.
