The complainant alleged that the appellant demanded Rs. 9,000, accepted Rs. 3,000 as part payment, and was caught in a trap laid by the Anti-Corruption Bureau (ACB).

Motor Vehicles Act, 1988 – Compensation for Motor Accident Claims – This appeal challenged the quantum of compensation awarded to a claimant who suffered the amputation of his right leg below the knee in a motor accident on September 28, 2011. The Motor Accident Claims Tribunal initially awarded Rs. 10,30,500/-, which the High Court subsequently enhanced to Rs. 15,99,000/-, both with 7.5% interest.

The Maharashtra Regional and Town Planning Act, 1966 (Sections 126, 127, 47), The Land Acquisition Act, 1894 (Section 6), The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Sections 11, 26, 28) - This appeal concerns compensation for 37 Ares of land in Nashik, reserved and partially occupied by the Municipal Council (now Corporation) since 1972, but formally acquired only in 2017. The Appellant, a subsequent purchaser, challenged the compensation awarded by the Special Land Acquisition Officer (SLAO).

The Land Acquisition, Rehabilitation and Resettlement Authority (Reference Court) enhanced compensation to Rs. 20,20,11,533/- and awarded substantial rental compensation for illegal occupation from 1972.

Civil Procedure Code, 1908 (CPC) – Order 41 Rule 5(1) and Rule 5(3) – This judgment addresses a Special Leave Petition against a High Court order that stayed the execution of a money decree without requiring the judgment debtor (Amazon Tech) to deposit the decretal amount. The original suit involved trademark infringement claims by the plaintiffs (Beverly Hills Polo Club) against the defendant. The High Court granted the stay based on several factors:

The judgment highlighted the systemic failure to implement statutory mandates, provide accessibility, and ensure proper care in state-run institutions for persons with cognitive disabilities.

The Court underscored that disability is a fundamental aspect of human diversity, requiring an inclusive constitutional vision (Articles 14, 19, and 21 of the Constitution of India) that guarantees dignity, autonomy, and equality. It criticized the casual attitude towards enforcing disability rights and the lack of accessible infrastructure.

Indian Penal Code, 1860 (IPC) – Sections 420, 463, 464, 465, 467, 468, 471 and 474 read with Section 34 & Code of Criminal Procedure (CrPC) – Section 438 – This case involves two criminal appeals against a judgment by the Bombay High Court, which dismissed the appellants’ anticipatory bail applications related to F.I.R. No. 30/2019. The FIR was lodged based on a complaint alleging offences under the Indian Penal Code, 1860, including forgery and cheating, related to land transfer based on forged documents.

Motor Vehicles Act, 1988 – This judgment addresses two Civil Miscellaneous Appeals arising from a Motor Accident Claims Tribunal decision. C.M.A.(MD)No.40 of 2025 was filed by the Transport Corporation challenging the quantum of compensation and the finding of negligence against its driver. C.M.A.(MD)No.553 of 2024 was filed by the claimant seeking an enhancement of the compensation awarded by the Tribunal.

The accident occurred when a Government Bus belonging to the Transport Corporation collided with a two-wheeler on which the claimant was a pillion rider, resulting in grievous injuries to the claimant.

Real Estate (Regulation and Development) Act, 2016 (RERA) Section 3 and Section Section 11(4)(c) – This judgment addresses the question of whether registration under the Real Estate (Regulation and Development) Act, 2016 (RERA) is mandatory for real estate projects where units are leased instead of sold. The court considered two cases: one involving a property intended for lease to IT companies and another concerning a Waqf property leased for 18 years.

The Tamil Nadu Real Estate Regulatory Authority (TNRERA) argued that RERA aims to regulate the real estate sector, ensure transparency, and protect consumers. They contended that all projects should be registered, regardless of whether units are sold or leased.

Habeas Corpus – Constitutional Law – Article 22 – A writ of habeas corpus may be sought if an arrest and subsequent detention are found to be illegal. Compliance with Article 22 of the Constitution, which mandates that an arrested person must be informed “as soon as may be” of the grounds for their arrest, is a constitutional safeguard against illegal detention. The grounds of arrest provided must be meaningful and complete, not a mere formality, to enable the arrested person to seek legal recourse effectively.

Criminal Procedure – Bharatiya Nagarik Suraksha Sanhita (BNSS) – Sections 47 & 48 – Under Section 47 of the BNSS, an arrested person must be “forthwith” informed of the “full particulars of the offence.” The obligation to inform the arrested person of the grounds for arrest cannot be fulfilled by later serving the remand report, as this violates the “as soon as may be” and “forthwith” requirements.
