Negotiable Instruments Act, 1881 – Section 138 – This appeal challenged the High Court’s decision to acquit the accused under Section 138 of the Negotiable Instruments Act, 1881, reversing the concurrent convictions by the Trial Court and Sessions Court. The appellant argued that the High Court erred in its revisional jurisdiction, overlooking the established facts of the dishonored cheque being issued for a legally enforceable debt. The appellant also contended that the accused failed to prove the complainant’s lack of financial capacity to advance the loan and highlighted the accused’s willingness to pay the cheque amount during sentencing.

The respondent argued that the complainant’s low salary at the time made it impossible for him to provide such a substantial loan.

Companies Act, 2013 – Sections 210, 211, 212, 213 – The Original Side Appeals (OSAs) were filed by the Administrator appointed to administer Zylog Systems Limited, challenging an order of the Company Court that directed the Serious Fraud Investigation Office (SFIO) to conduct a detailed enquiry into the company’s affairs.

The Company Court’s decision stemmed from allegations of fund diversion to foreign subsidiaries and other misfeasance, noting ongoing proceedings against the company by various agencies like SEBI, CBI, and ED. The Administrator argued that the Company Court lacked the statutory authority under Section 212 of the Companies Act, 2013, to directly refer the matter to the SFIO, as such referrals are typically initiated by the Central Government.

The Court examined Sections 210 to 213 of the Companies Act, 2013, emphasizing that while the Central Government primarily directs investigations by the SFIO, Section 210(2) mandates the Central Government to order an investigation when a Court or Tribunal requires it.

Criminal Procedure Code, 1973 (Cr.P.C.) – Section 482 – Quashing of FIR – Scope of High Court’s power: The High Court, when exercising its power under Section 482 Cr.P.C. to quash an FIR, must primarily determine if a prima facie case disclosing the ingredients of the alleged offence is made out from the FIR or complaint. It is not to conduct a mini-trial, appreciate evidence, or consider defense arguments at this preliminary stage.

Indian Penal Code, 1860 (IPC) – Sections 420, 406, 34 – Cheating, Criminal Breach of Trust: Where a bank customer alleges fraudulent revaluation and misappropriation of pledged gold after full loan repayment, and the bank claims the gold was counterfeit, a prima facie case of cheating and criminal breach of trust is made out, warranting a trial to determine the facts and intentions of the parties involved.

Motor Vehicles Act (M.V. Act) Section 166 and Haryana Compensation Assistance to the Dependents of Deceased Government Employees Rules, 2006 – This case involves a claim for compensation filed by the legal heirs of a deceased government employee who died in a motor accident. The Motor Accident Claims Tribunal awarded Rs. 37,85,800, which was appealed by both the Insurance Company (challenging the quantum and seeking deductions for financial assistance received under the 2006 Rules) and the claimants (seeking enhancement).

Criminal Procedure Code (Cr.P.C.) – Section 374(1) – Appeal against conviction; Indian Penal Code (IPC) – Sections 420 & 406; Tamil Nadu Protection of Interests of Depositors (TNPID) Act – Section 5 – Compounding of offenses. The appellant was convicted under Sections 420 & 406 of the IPC and Section 5 of the TNPID Act for defaulting on repayments to depositors. During the appeal, the appellant agreed to settle the principal amount due to the remaining 13 unsettled depositors. The appellant deposited the entire sum, and the depositors received their respective amounts.

The depositors and the appellant sought to compound the offenses.

Criminal Procedure Code, 1973 (Cr.PC) – Section 482 – Prevention of Money Laundering Act, 2002 (PMLA) – Section 45(1) r/w Sections 3 and 4- The petitioners, accused in both a predicate offence and a PMLA case, sought to set aside an order dismissing their petition to stay proceedings in the PMLA case (Spl CC No.2 of 2023) until the predicate offence case (CC No.22 of 2014) reaches finality.

The Enforcement Directorate (ED) registered a case following a CBI FIR related to corruption, alleging the accused amassed disproportionate assets.

The ED provisionally attached properties but the adjudicating authority did not confirm the order.The petitioners argued that the predicate offence trial should precede the PMLA trial, relying on the Supreme Court’s Vijay Madanlal Choudhry case.

• The prosecution countered that PMLA proceedings are independent, triggered by the predicate offence but not dependent on its outcome, citing Section 44 of PMLA.
  

 The Representation of the People Act, 1951 & The Conduct of Election Rules, 1961 – The Supreme Court addressed petitions questioning the reliability of Electronic Voting Machines (EVMs) and seeking either a return to paper ballots or 100% Voter Verifiable Paper Audit Trail (VVPAT) slip counting. The petitioners, while not alleging malice by the Election Commission of India (ECI), expressed concerns about EVM manipulation and sought measures to enhance voter confidence.

The Court reviewed past cases upholding EVM use and transparency. It emphasized the extensive safeguards, including pre-election checks, randomization processes, and the VVPAT system, designed to prevent tampering.

• Negotiable Instruments Act, 1881 – Section 138 – Dishonour of Cheque – Legally Enforceable Debt: For a successful prosecution under Section 138, the complainant must prove the existence of a legally enforceable debt or liability for which the cheque was issued. Mere issuance of a cheque and dishonour are insufficient if the underlying debt is not established or is successfully rebutted.
• Negotiable Instruments Act, 1881 – Sections 118 & 139 – Presumption of Guilt – Rebuttal: The presumption under Sections 118 and 139 that a cheque was issued for a legally enforceable debt is rebuttable. The accused can rebut this presumption by raising a plausible defence on the ‘preponderance of probabilities’, even without proving their defence beyond reasonable doubt. The High Court and Appellate Court are entitled to re-evaluate evidence to determine if the presumption was rebutted.
• Criminal Procedure Code, 1973 – Section 378 – Appeal against Acquittal – Scope of Interference: In an appeal against acquittal, especially when there are concurrent findings of two appellate courts, the Supreme Court’s interference is limited to cases where findings are perverse or based on no evidence.

Final Decision:    The Supreme Court dismissed the special leave petitions, upholding the acquittal of the accused.

(Land Acquisition Compensation under NH Act)

National Highways Act, 1956: Sections 3A(1), 3G(1), 3G(5) - Arbitration and Conciliation Act, 1996: Sections 34, 37 - Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013: Section 26(1) and its Explanations - The National Highways Authority of India (NHAI) challenged the enhanced compensation awarded for land acquired for National Highway No. 547-E widening. The Competent Authority initially valued the land as agricultural. However, the landowner, Alfa Remidis Ltd., successfully argued before an Arbitrator that its land was used for industrial purposes, securing an award of Rs.

(Quashing of Charge for Abetment of Suicide)

The Indian Penal Code, 1860Sections 306 (Abetment of suicide) and 34 (Acts done by several persons in furtherance of common intention) read with Section 107 (Abetment of a thing) of, and Sections 438 and 442 of the Bhartiya Nyaya Suraksha Sanhita, 2023 - The appellant challenged an order of the Chhattisgarh High Court which had refused to quash a charge framed against him under Section 306 read with Section 34 of the Penal Code. The charge stemmed from the suicide of Komal Sahu by hanging. The First Information Report indicated suicide, and a subsequent investigation implicated the appellant and the deceased's wife, Revati Bai, alleging illicit relations between them and Revati Bai's insults towards the deceased in the appellant's presence, which supposedly led Komal Sahu to commit suicide.

The appellant contended that the prosecution material lacked sufficient evidence to establish abetment, specifically arguing the absence of any proximate act of instigation, a suicide note, or definitive proof of illicit relations beyond hearsay.
