Hindu Succession Act, 1956 – Section 15 – This case involves a dispute over the partition of property originally belonging to Ranganayaki, who passed away intestate in 2006. Her daughter, Rajalakshmi, filed a suit for partition, claiming that the property devolved equally among Ranganayaki’s four children (including herself). Another daughter, Amsaveni, contested this, asserting ownership based on a will allegedly executed by Ranganayaki in her favor. Amsaveni claimed to have purchased the suit property in the name of her mother Ranganayaki as per the advice of astrologer, using her husband’s retirement benefits.

Tamil Nadu Patta Passbook Act, 1983 – Section 2(5), 2(6), 3(1) – This case involves a challenge to a writ court order that directed the state government to grant patta (land ownership documents) to individuals, primarily Scheduled Tribes, who had been cultivating lands in the Kalvarayan Hills. The State appealed, arguing that the lands were classified as forest lands, making the patta grants a violation of the Forest Act. The respondents, however, contended that they were entitled to patta due to their long-term possession and cultivation of the lands.

The District Collector’s proceedings from 1999 revealed that the lands were classified as “Kadu Poramboke” (forest land) due to a misinterpretation of the local term for cultivated land.

Companies Act, 2013 – Section 9 – This civil revision petition was filed by Defendants 2 and 3, challenging the order in I.A.No.286 of 2017, which denied their request for unconditional leave to defend a suit (O.S.No.4527 of 2017) for recovery of monies. The suit was filed against M/s.Dream Systems Private Limited (Defendant 1) and its Directors (Defendants 2 and 3). The revision petitioners argued that, according to Section 9 of the Companies Act, 2013, Directors of a private limited company cannot be held personally liable for the company’s dues unless there’s a specific contract stating otherwise.

The petitioners contended that the plaint lacked any averment establishing how the Directors could be held personally liable.

The Indian Evidence Act Section 51; The Constitution of India Article 25 – This writ petition was filed by a devotee of Sri Varadaraja Perumal Temple, challenging the temple management’s decision to cancel the Urchavar procession for the Vijayadasami festival and Pavithrotsavam, citing that “Balalayam” had taken place and an agamic expert advised against processions until renovation completion. The petitioner argued that the procession should proceed based on another expert’s opinion.

The court noted the differing opinions of the two experts. It emphasized that the opinion of an expert is not final or binding on the court.

Indian Evidence Act – Section 4, 63, 68, 69 & 90; Indian Succession Act – Section 63; Civil Procedure Code – Order 41 Rule 27 – This case involves two Original Side Appeals (OSAs) arising from a common judgment concerning a suit for probate of a will (T.O.S.No.47 of 2013) and a suit for partition (C.S.No.722 of 2018). The central dispute revolves around the genuineness of a will and codicil allegedly executed by Tmt.S.Balambal in 1961.

The appellants sought to probate the will, claiming testamentary succession. The respondent contested the will, asserting intestate succession and seeking partition of the properties.

Industrial Disputes Act, 1947 – This writ petition challenges the order of the Principal Labour Court, Coimbatore, in I.D. No. 26 of 2020, dated 31.03.2021, which directed the petitioner Management to grant review benefits to the workman, A. Thangavel, from 01.08.2013.

Tamil Nadu State Housing Board Act, 1961 & Land Acquisition Act, 1894 Section 18 And Section 23 – This case involves two Civil Revision Petitions challenging the execution of a decree related to land acquisition compensation. The Tamil Nadu State Housing Board, a statutory body, acquired land under the Land Acquisition Act, 1894, for housing development. The landowners sought enhanced compensation, which was granted by the Reference Court along with interest and solatium.

Initially, the decree was amended based on a memo from the Housing Board, removing interest on solatium, and the claimants received the compensation.

Indian Penal Code (IPC) – Section 420 & Prevention of Corruption Act, 1988 – Section 13(2) read with Section 13(1)(d) – This case involves an appeal against the conviction of T. Elangovan, an employee of New India Assurance Company Limited, under Section 420 of the IPC and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. The prosecution alleged that Elangovan traveled abroad multiple times without proper permission or leave sanction, receiving salary for the unauthorized absence, thus causing wrongful loss to the company and gaining wrongful benefit himself.

The trial court convicted Elangovan, but the High Court overturned the conviction.

Prevention of Corruption Act, 1988 (PC Act) – Sections 2(c)(i), 7, 13(1)(d) and 13(2) – Determination of a ‘Public Servant’ and Offence of Corruption – The core issue revolves around whether a licensed stamp vendor falls under the definition of a “public servant” according to Section 2(c)(i) of the PC Act and the legality of conviction under sections 7 and 13.

The court emphasized a broad interpretation of “public servant” under the PC Act, focusing on the nature of the duty performed rather than the mode of appointment or remuneration.

The term “remuneration” includes discounts received by stamp vendors, as it is payment received for public duty. The nature of the public duty is what makes a person a public servant.
