Land Acquisition – National Highways Act, 1956 Section 3G(1)– Compensation Apportionment – Landlord vs. Cultivating Tenant: In land acquisition cases under the National Highways Act, 1956, where there is a dispute between a landlord (temple) and a cultivating tenant over compensation, and the tenant has not conclusively established continuous cultivation or a right to purchase the land, a fair and equitable apportionment of compensation is 75% to the landlord and 25% to the cultivating tenant.

Land Acquisition – Determination of Rights – Role of Civil Court vs. Apportioning Authority: While specific statutory provisions (like Section 3G of the National Highways Act) guide compensation, in cases of dispute, the authority determining compensation can apportion the amount based on the nature of rights and evidence presented, without necessarily directing parties to a civil court if prima facie facts allow for equitable distribution.

Indian Maritime University Act (IMU Act) – Section 49 – This case involves a challenge to the dismissal and penalty imposed on the former Vice-Chancellor and Director of the Chennai Campus of the Indian Maritime University (IMU). The writ petitioner was accused of accumulating disproportionate wealth and causing financial loss to the university, leading to disciplinary proceedings and his eventual dismissal. The core issue revolves around whether the alleged misconduct, which occurred before his appointment as Vice-Chancellor, could be used as grounds for disciplinary action by the university. The applicability of the University Teaching and Non-Teaching Employees (Terms and Conditions of Service) Rules (UTNTE Rules) to the Vice-Chancellor, an officer appointed independently by the President of India, was also contested.

The Mineral Concession Rules, 1960, Section 22 and 72; the Mines and Minerals (Development and Regulation) Act, 1957 Section 9 and 24(A) – This judgment addresses a batch of 19 Writ Appeals and 13 Writ Petitions concerning the levy of surface compensation by the State of Tamil Nadu under Section 72 of the Mineral Concession Rules, 1960, for mining leases on government-owned “poramboke” lands. The appellants/petitioners, who are lessees exploiting minerals like bauxite and limestone, argued that Rule 72 applies only to privately owned lands, not government lands, as the government cannot be considered an “occupier” of its own land. They also contended that the computation of compensation lacks a proper basis and violates the principles of natural justice.

The State countered that no such distinction exists between poramboke and patta lands, and that accepting the appellants’ argument would discriminate against the State.

Consumer Protection Act, 1986 (CPA, 1986) – Section 23 – This case involves appeals against the National Consumer Disputes Redressal Commission (NCDRC)’s order regarding a complaint filed by Dharmendra Sharma against the Agra Development Authority (ADA) for deficiency in service related to the allotment of a flat. Sharma applied for a flat in 2011, made full payment, but possession was delayed, and the offer of possession in 2014 was contingent on additional payments and lacked necessary completion and firefighting clearance certificates. The NCDRC partly allowed Sharma’s complaint, ordering a refund with interest from the complaint date. Both Sharma and ADA appealed, with Sharma seeking interest from the deposit date and ADA contesting limitation and pecuniary jurisdiction.

(Counting Break in Service for Pensionary Benefits)

This Full Bench judgment primarily interprets Rules 24 and 25 of the Tamil Nadu Pension Rules, 1978, concerning the counting of 'break in service' for pensionary benefits. It also clarifies the precedential value of an in-limine dismissal of a Special Leave Petition under Article 141 of the Constitution of India.

The matter was referred to the Full Bench after conflicting Division Bench decisions regarding whether the period of temporary service, including breaks, should be counted for pension. Petitioners sought the inclusion of such periods, with some earlier judgments granting relief based on parity with other employees whose services were regularized.

Land Acquisition (Special Railway Projects) Rules, 2016, Railways Act, 1989 – Section 20-F(6) – This case concerns the acquisition of land for a Special Rail Project in Chhattisgarh and challenges the setting aside of a compensation award. The High Court had set aside the initial award and subsequent arbitral award based on allegations of excessive compensation paid to some landowners in collusion with officials. The appellant, another landowner, was also affected by this decision, despite not being implicated in the allegations of collusion or unjust enrichment.

The Railways had specifically targeted a few landowners and government officials, initiating criminal proceedings and filing writ petitions against them.

Tamil Nadu Panchayats Act, 1994 – Sections 202 and 203 – Challenge to District Collector’s order canceling tender for laying roads in villages.

The writ petitioner, a Union Councillor, contested the District Collector’s order, arguing it violated natural justice and Section 202 of the Tamil Nadu Panchayats Act, 1994, by canceling a tender for road construction without prior notice or inquiry. The petitioner contended that resolutions were unanimously passed by the Panchayat and funds were available.

However, the respondent argued that the Panchayat had a negative balance, and Show Cause Notices were issued due to deficit funds.

Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act, 1976 (SAFEMA) – This case involves a writ appeal against the order of a single judge who quashed a show cause notice issued under Section 6(1) of SAFEMA. The notice was initially issued to Smt. Mohammed Thahaumma, wife of a detenu Mr. S.S.A.

Advocates Act, 1961 – Sections 6, 35, 36, 48A – The petitioner, an advocate, challenged a resolution by the Bar Council of Tamil Nadu prohibiting him from practicing law pending disposal of a criminal case and disciplinary proceedings initiated against him. The petitioner argued the resolution violated principles of natural justice and his constitutional rights under Article 19(1)(g). The Bar Council defended its action citing the Advocates Act, 1961, and the need to maintain the decorum of the legal profession, contending the petitioner had an alternate remedy through revision to the Bar Council of India.

The Court examined the maintainability of the writ petition, the nature of the right to practice law, and the Bar Council’s jurisdiction to issue interim suspension orders.

Code of Civil Procedure, 1908 (CPC) – Order 39 Rules 1 and 2, Order 43 Rule 1, Section 104, Section 151 – The appeal concerns an order of the High Court of Gujarat that overturned the trial court’s grant of a temporary injunction in a property dispute. The plaintiffs filed a suit seeking declaration, cancellation of a sale deed, and a permanent injunction against the defendants, alleging that the defendant no. 1 fraudulently transferred property to defendant no. 3 based on a misused power of attorney.
