Criminal Procedure Code, 1973 (Cr.P.C.) – Section 125 and Maintenance and Welfare of Parents and Senior Citizens Act, 2007 – This Criminal Revision Case was filed challenging the order of the Judicial Magistrate, Paramakudi, which dismissed the petitioners’ application for monthly maintenance of Rs.30,000 from the respondent (husband of the first petitioner) under Section 125 of Cr.P.C.

The petitioners argued that the respondent, a retired employee of NTC Mills, has considerable immovable properties and retirement benefits, and the first petitioner is unable to maintain herself and arrange the marriage of their third daughter. The respondent contended that the first petitioner has filed multiple civil suits against him, and he is a bedridden senior citizen requiring significant medical expenses and has been neglected by his family.

The Court considered the arguments, evidence, and relevant legal provisions, including Section 125 Cr.P.C.

Arbitration and Conciliation Act, 1996 – Section 16 and 37; Article 227 of the Constitution of India – This Civil Revision Petition was filed under Article 227 of the Constitution of India seeking to set aside an Arbitral Award concerning a loan transaction between the petitioner and the 1st respondent/Bank, with respondents 2 to 5 as guarantors. The petitioner contended that the arbitration clause in the loan agreement was improperly invoked as proceedings were already pending before the Debt Recovery Tribunal, making the arbitration jurisdictionally flawed.

The petitioner also argued that the Arbitrator passed the award on the same day as the preliminary meeting without providing a fair opportunity. The respondent/Bank argued that the revision petition was not maintainable and the petitioner should have filed an application under Section 16 of the Arbitration and Conciliation Act, 1996, and appeal under Section 37 of the Act.

Civil Procedure Code, 1908 – Order XII Rule 6 – Judgment on Admissions: The power to pass a judgment on admissions under Order XII Rule 6 of the CPC is discretionary and permissive, not mandatory. It can be exercised at any stage of the suit based on clear, unequivocal, and unconditional admissions made in pleadings or otherwise, orally or in writing. The primary object is to enable speedy judgment to the extent of the admitted claim.

West Bengal Premises Tenancy Act, 1997 – Section 2(g) – Inherited Tenancy: Under Section 2(g) of the West Bengal Premises Tenancy Act, 1997, a dependent heir (other than the spouse) of an original tenant has the right to continue as a tenant for a period not exceeding five years from the date of the original tenant’s demise.

Civil Procedure Code, 1908 (CPC) – Order XII Rule 6; West Bengal Premises Tenancy Act, 1997 – Section 2(g) – This case concerns a suit for eviction filed by the plaintiff against the defendant, who claimed tenancy rights through his deceased father. The plaintiff argued that the defendant’s permissible tenancy period, as per Section 2(g) of the West Bengal Premises Tenancy Act, 1997, had expired.

The defendant admitted in his written statement that his father was the original tenant and that he resided in the suit premises until his father’s death. Based on these admissions, the plaintiff sought a decree under Order XII Rule 6 of the Civil Procedure Code.

Guardians and Wards Act, 1890 Section 7 & Family Courts Act, 1984 Section 7(1)(g) – This revision petition challenges the order of the Family Court returning an application filed under Section 7 of the Guardians and Wards Act, 1890, read with Section 7(1)(g) of the Family Courts Act, 1984, seeking appointment as guardian for both the person and property of a minor. The Family Court returned the petition, stating it only had jurisdiction over guardianship of the person, not property.

The petitioner argued that “guardianship in relation to” in Section 7(1)(g) of the Family Courts Act includes guardianship of property and that the Family Court should be deemed a District Court under Section 7(1)(b), granting it powers under the Guardians and Wards Act. They further argued that requiring separate filings for person and property guardianship would cause hardship.

Tamil Nadu Buildings (Lease and Rent) Control Act, 1960 Section 10; Transfer of Property Act 1882 Section 109 –  This civil revision petition arises from an order reversing the eviction order passed by the Rent Controller. The landlady filed R.C.O.P. No. 91 of 1995 seeking eviction of the tenant based on wilful default, denial of title, and own use.

This case concerns a petition filed by Battu Devanand seeking compassionate appointment in Tamil Nadu Generation and Distribution Corporation Ltd. (TANGEDCO) after his father, an employee, passed away in 2005. The petitioner’s mother applied for compassionate appointment in 2006 but also passed away in 2007. The petitioner, after obtaining a Diploma in Electrical Electronics Engineering, applied in 2018.

Arbitration and Conciliation Act, 1996 – Section 9 & 17 – This case involves Civil Revision Petitions seeking to strike off Original Petitions filed under Section 9 of the Arbitration and Conciliation Act, 1996, before the Principal District Judge, Chengalpattu. The dispute arose from a lease agreement between the petitioner (lessee) and the 1st respondent (lessor) due to alleged non-payment of rentals.

The petitioner argued that the arbitration clause stipulated Chennai as the exclusive jurisdiction and venue for arbitration, making the application in Chengalpattu non-maintainable. The 1st respondent contended that the property’s location within Chengalpattu’s jurisdiction justified the proceedings there.

Constitution of India Article 21 and 226 – This writ petition was filed by an advocate and CPI council member seeking a writ of certiorarified mandamus to quash an order denying him personal security at the state’s expense and to direct the respondents to provide him with such security.

The petitioner claimed threats due to his father’s murder by a notorious rowdy and a subsequent attack on himself. He had previously received state-funded police protection, which was withdrawn after he was implicated and arrested in the murder of the rowdy who killed his father, despite his detention under the Tamil Nadu Act 14 of 1982 being later quashed.

The respondent denied the request, citing the petitioner’s involvement in the rowdy’s murder, numerous criminal cases against him, and his status as a history sheeter.

Civil Procedure Code, 1908 (CPC) – Section 50 – This revision petition, filed by the decree holder, challenged the Executing Court’s dismissal of an application under Section 50 CPC. The application aimed to implead the legal representatives of a deceased judgment debtor. Following a decree, possession of the property was delivered and the execution petition (EP) was closed. However, the judgment debtor subsequently re-trespassed onto the property before his death.
