(Election Law - Disqualification and Consequential Relief)

The Orissa Panchayat Samiti Act, 1959, specifically Sections 45(1)(v), 44-E, and 44-J - This civil appeal arose from a High Court judgment which upheld the disqualification of the respondent-returned candidate (Basanti Sahoo) from the posts of Panchayat Samiti Member and Chairman of Delang Panchayat Samiti, but directed re-election for the Chairman's post.

The appellant-election petitioner (Ramadebi Rautray) had challenged the respondent's election, alleging disqualification under Section 45(1)(v) of the 1959 Act for having a third child after the cut-off date. The Election Tribunal found the respondent's election invalid due to uncontroverted evidence and declared the appellant elected as Chairman.

The Election Appellate Tribunal and the High Court affirmed the respondent's disqualification but set aside the declaration of the appellant as Chairman, ordering a fresh election.

Code of Civil Procedure, 1908 (CPC) – Section 96, Order XLI Rule 1; Indian Evidence Act, 1872 – Sections 103, 120 – This appeal challenged a Trial Court’s decree of specific performance regarding a property sale agreement. The plaintiff claimed a sale agreement was executed for Rs. 22 lakhs, with a Rs. 20 lakh advance, and sought specific performance from the defendant.

Revenue Standing Order No. 21(7)(ii) – Assignment of Natham land and cancellation – This intra-court appeal challenged the cancellation of a ‘Natham’ house site assignment made in 1994 to the appellant under Revenue Standing Order No. 21(7)(ii). The assignment was conditional upon constructing a residential house within a specified timeframe.

(Family Partition, Validity of Family Arrangement and Will)

This common judgment addresses appeals concerning family partition, the validity of a family arrangement, and a Will. The relevant legal principles include those of Hindu Law regarding partition, reunion, and testamentary succession, as well as the Indian Evidence Act, 1872 (specifically Section 33 for the admissibility of evidence).

The plaintiffs are the elder sons of the late M.S.P. Rajes (Second Defendant), who had previously partitioned properties with them.

(Equivalence of Open University Foundation Courses for Public Employment)

University Grants Commission Act, 1956: Section 26(1)(f), (g), (h) * Indira Gandhi National Open University Act, 1985 - Constitution of India: Article 141, Entry 66 of List I, Entry 25 of List III - This Full Bench judgment clarified the validity of degrees obtained through Open University Pre-Foundation/Foundation courses for public employment and promotion, specifically their equivalence to 10th and 12th standard formal education. Key legal considerations included the University Grants Commission Act (UGC Act), the Open University Act, and Article 141 of the Constitution.

The Hon'ble Supreme Court in Annamalai University vs. Secretary to Government [(2009) 4 SCC 590] declared degrees obtained without 12 years of formal schooling (10+2) invalid as per UGC Regulations, establishing the UGC Act's supremacy.

(Partition of Joint Family Properties and Effect of Sale by Co-owner)

The Hindu Succession Act, Order 41 Rule 27 of the Civil Procedure Code, and Section 3 of the Hindu Gains of Learning Act, 1930. The plaintiff sought partition of inherited properties (A, B, C Schedules), claiming a half share. He alleged that the 1st defendant (elder brother) fraudulently obtained a legal heirship certificate, suppressing the plaintiff’s existence, and sold A & B Schedule properties. The C-Schedule property, jointly mortgaged, was redeemed by the 1st defendant after a court auction. The 1st defendant contended that A & B properties were sold for family debts, and C-Schedule was redeemed solely by him.

Indian Penal Code, 1860 (IPC) – Sections 498A, 304B; Indian Evidence Act, 1872 – Section 113B; Code of Criminal Procedure, 1973 (Cr.P.C.) – Section 174(3) – This criminal appeal challenged the conviction of four appellants for offences under Sections 498A (cruelty) and 304B (dowry death) IPC. The deceased, married in 2016, committed suicide by hanging in her parents’ home in 2018, within seven years of marriage. The prosecution alleged dowry harassment after the birth of a child, relying on testimony from the deceased’s parents and brother (PW1-PW3), a suicide note (Ex.P2), and a video recording.

The Court noted that while the deceased died within seven years of marriage, invoking a presumption under Section 113B of the Evidence Act requires proof of cruelty or harassment related to dowry ‘soon before death’.

Presidency Towns Insolvency Act, 1909 (PTI Act) – Section 21 – This appeal challenged an order refusing to release a flat from an insolvent’s estate, which had vested in the Official Assignee. The property owners (Respondents 3 & 4) were adjudicated as insolvents in 1998, following a petition filed by M/s. Cathedral Chits Private Limited and M/s. MBF Chits Private Limited (Respondents 1 & 2) under the PTI Act.

(Partition Suit - Character of Property and Scope of Second Appeal)

Code of Civil Procedure, 1908 (CPC), Section 100 - Hindu Succession Act, 1956, Section 8 - This Second Appeal arose from concurrent judgments dismissing a son's (plaintiff's) suit for partition and a 1/4th share in properties against his father (first defendant) and sisters (defendants 2 & 3).

The plaintiff claimed Item 1 of the properties was ancestral, having been allotted to his father in a 1967 family partition. He further argued that Items 2 & 3 were joint family properties, purchased by the father from the income derived from Item 1.

The first defendant contended that all suit properties were his separate acquisitions.

Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) – Section 8(c) r/w 22(c), 28, 29, 37, 52(1) – Code of Criminal Procedure, 1973 (CrPC) – Section 50 – Constitution of India – Article 21, 22(1), 22(5) – The petitioner, arrayed as A2, sought bail in a case under the NDPS Act concerning the seizure of 2.700 kg of Amphetamine, a commercial quantity. His previous bail plea was dismissed.
He contended false implication, abduction, and crucially, non-compliance with mandatory arrest procedures, particularly the non-communication of grounds of arrest. The prosecution opposed, citing the commercial quantity and rigours of Section 37 NDPS Act.
