Code of Criminal Procedure, 1973 (CrPC) – Section 319 & Indian Evidence Act, 1872 – Section 32 – Addresses the dismissal of an application under Section 319 of the CrPC, seeking to summon additional accused individuals (relatives of the husband) in a case involving murder. The initial FIR was filed against the husband for shooting his wife, who later died. During the investigation, the deceased, in her statements under Section 161 CrPC, implicated the husband’s relatives (respondents) for instigating the crime. However, the police filed a chargesheet only against the husband.

Code of Civil Procedure Order VII Rule 1 r/w. Order IV Rule 1 – Civil suit filed by the plaintiff against his wife (Defendant 1) seeking partition of properties. The plaintiff claimed that although the properties were in the name of the first defendant, they were purchased jointly using his savings, bank loans (where he stood as guarantor), and his provident fund withdrawals. He alleged that the properties were acquired during their marriage and that he has a half share in them.

Registration Act, 1908 – Sections 71, 72, and 77 –  Writ appeal against an order dismissing a writ petition that challenged the refusal of a Sub-Registrar to register a settlement deed. The Sub-Registrar refused registration because another person possessed a document related to the property and the presentant of the deed did not have absolute rights to the property.

The High Court noted that writ courts should generally not decide disputed facts concerning civil rights and that the proper course is to exhaust remedies within the Registration Act. The Act provides a mechanism for appealing refusals to register, first through an inquiry by the Registering Authority (Section 71), then via appeal to the District Registrar (Section 72), and finally, through a civil suit (Section 77).

Specific Relief Act, 1963 – Section 19(b) ; Transfer of Property Act, 1882 – Section 52 & 55 ;
Civil Procedure Code, 1908 – Section 100 & Order 1 Rule 10 – A suit for specific performance based on a sale agreement. The defendant denied executing the agreement, claiming it was fabricated. The lower courts dismissed the suit primarily due to the non-joinder of a prior purchaser (D.W.3) to whom the defendant had already sold the property before the suit was filed.

The High Court framed substantial questions of law, including whether the lower courts erred in dismissing the suit due to non-joinder, whether the findings on coercion were perverse, and whether the courts improperly delved into the issue of title.

Tamil Nadu Societies Registration Act, 1975 – Sections 18, 20, and 21; Civil Procedure Code (CPC) – Section 47, Order 21 Rule 89 and 90, Section 151 – The case involves a challenge to the execution of a decree against a Society registered under the Tamil Nadu Societies Registration Act, 1975. The revision petitioner, the 1st defendant and judgment debtor, contested the execution proceedings initiated by the 1st respondent/decree holder, primarily on the grounds of non-compliance with the Act’s mandatory provisions regarding representation of the Society in legal proceedings. The petitioner argued that since the Society was not properly represented, and the decree was partly passed against deceased individuals, the decree was inexecutable. Additionally, he questioned the sale of the property for a significantly lower price.

Code of Civil Procedure of (C.P.C) Section 100 – Dispute over a 1.93-acre property in Tamil Nadu, specifically regarding Survey No. 44/1. The plaintiff, a temple, sought a permanent injunction against the defendant to prevent disturbance of their possession, claiming ownership based on several sale deeds. The defendant contested the title, asserting ownership of 33 cents within the 1.93 acres, claiming adverse possession and raising questions about the plaintiff’s title and the suit’s maintainability.

Tamil Nadu Duty on Transfers of Property (in Municipal Areas) Act, 2009 (Act 32 of 2009) – Section 3 – Partnership firm that purchased property in an auction conducted by the official liquidator and subsequently paid a 2% surcharge under protest when the registering officer demanded it during the registration of the sale certificate. The petitioner argued that the surcharge was illegally levied, citing previous court decisions. The respondents contended that the surcharge was valid under Section 3 of the Tamil Nadu Act 32 of 2009, arguing that the sale certificate acquired the character of a conveyance upon registration, making it subject to the surcharge.

The court considered arguments based on the interpretation of “instrument” under the Indian Stamp Act, 1899, and the applicability of Section 3 of the Tamil Nadu Act 32 of 2009 to sale certificates.

Facts: The appellants, legal heirs of a judgment debtor, challenged the execution of a sale deed in favor of the first respondent (assignee) based on an unregistered assignment deed of a decree for specific performance. The Executing Court initially sided with the appellants, but the High Court reversed this decision, holding that the assignment deed was not compulsorily registrable.

Issue: The core question was whether a deed assigning a decree for specific performance of an agreement to sell immovable property requires registration under the Registration Act, 1908.
