Code of Criminal Procedure, 1973 (CrPC) – Section 482, 156(3); Indian Penal Code, 1860 (IPC) – Sections 120B, 201, 419, 471, 468, 420; Code of Civil Procedure, 1908 (CPC) – Order 41 Rule 5, Section 151, Order 39 Rule 2-A – The appellant, as a complainant, challenged the High Court’s orders that quashed the Judicial Magistrate’s order for police investigation under Section 156(3) of the CrPC. The initial complaint was against the accused for offences under the IPC, including forgery and fraud, stemming from a property dispute where a fake E-Stamp Paper and Rent Agreement were allegedly created and presented in court proceedings related to a stay order.

The appellant contended that the presented Rent Agreement was based on a fraudulent E-Stamp Paper. The High Court erred in preventing the police from investigating the matter, especially considering the forgery and the conspiracy claims, and overlooked evidence presented.

Indian Penal Code, 1860 (IPC) – Sections 147, 148, 294(b), 323, 324, 506(ii); Tamil Nadu Prohibition of Harassment of Women Act, 2002 – Section 4 – This Criminal Original Petition was filed to quash the final report against the petitioners for offences under the IPC and the Tamil Nadu Prohibition of Harassment of Women Act, 2002. The allegation stems from a neighborhood dispute involving attacks with sticks and knives.

The petitioners argued that the police investigation was flawed, violating PSO 566 and guidelines established in the T.Balaji case, as a counter-complaint filed by the first petitioner was not properly considered.

The prosecution acknowledged the existence of the counter-complaint (Crime No.

Bharatiya Nyaya Sanhita, 2023 (BNS) – Section 69, Tamil Nadu Prohibition of Harassment of Women Act – Section 4 – This Criminal Original Petition sought to quash proceedings in P.R.C.No.24 of 2025, pending committal, based on a compromise between the petitioner (accused) and the de facto complainant. The FIR alleged sexual intercourse under a false promise of marriage and harassment. Both parties filed a Joint Memo of Compromise, affirming an amicable settlement to avoid further mental agony from the continuation of criminal proceedings.

While acknowledging that serious offences are generally not quashed solely on compromise, the Court examined the merits of the allegations, particularly under BNS Section 69.

Food Safety and Standards Act, 2006 – Sections 3(1)(zx), 3(1)(zz)(viii) & (xi), 26(1)(2)(i)(ii) & (v), 27(1), 27(2)(c) and 46(4) – This case involves a challenge to a private complaint filed by the Food Safety Officer against several parties, including the Managing Director of a retail store (A2), for offences related to substandard Aloe Vera Syrup. The Food Safety Officer alleged that the syrup contained excessive benzoic acid, rendering it unsafe. The central issue revolves around the delay in analyzing the food sample and the implications for the accused’s right to appeal.

The petitioner, A2, argued that the delay in analysis, which occurred beyond the product’s expiry date, deprived him of his right to appeal under Section 46(4) of the Food Safety and Standards Act, 2006.

Specific Relief Act, 1963 – Section 12 – This case concerns a suit for specific performance of an agreement to sell a property in Delhi, where the agreement stipulated the construction of eight flats. Disputes arose, and the defendant argued the agreement was, in effect, a loan transaction. Later, the defendant contended that constructing eight flats violated building bye-laws, rendering the agreement illegal and unenforceable. The plaintiff then invoked Section 12 of the Specific Relief Act, willing to accept the property “as is.”

The Trial Court decreed the suit, directing the execution of a sale deed.

Indian Penal Code, 1860 (IPC) – Section 302; Indian Evidence Act, 1872 – Section 8 & 27; Code of Criminal Procedure, 1973 – Section 313 – This case involves an appeal by Nilesh Baburao Gitte against his conviction for the murder of his mother. The prosecution’s case rested on circumstantial evidence, including the postmortem report indicating a homicidal death, the appellant’s presence and failure to report the death, his hasty arrangement of cremation, attempts to dispose of the body without legal procedures, discovery of blood-stained clothes matching the appellant’s blood, and an alleged motive of acquiring the deceased’s property.

The appellant argued that the cause of death was uncertain, possibly suicide, citing the absence of ligature marks around the entire neck in the postmortem report and the deceased’s history of schizophrenia. He also challenged the reliability of the recovery evidence and the testimony of a key witness (PW-3) due to existing property disputes and inconsistencies in statements.

Arbitration and Conciliation Act, 1996 – Section 34(2)(b)(ii) and Section 34(2A) –  This petition was filed under Section 34 of the Arbitration and Conciliation Act, 1996, by the petitioners challenging the award passed by the sole Arbitrator dated 25.02.2023. The dispute arose from a loan agreement dated 12.04.2018, where the respondent claimed the petitioners failed to repay a loan of Rs. 13 lakhs. The petitioners contested the loan agreement’s validity, alleging forgery and the respondent’s lack of financial capacity to lend such an amount.

Consumer Protection Act, 1986 Section 2(1)(g) – This case concerns allegations of medical negligence and deficiency in service against Dr. Kanwarjit Kochhar and Deep Nursing Home following the death of Manmeet Singh Mattewal’s wife and newborn son. The State Consumer Disputes Redressal Commission (SCDRC) initially found both the doctor and the nursing home negligent, awarding compensation to the complainants.

The National Consumer Disputes Redressal Commission (NCDRC) overturned part of the SCDRC’s decision, absolving the nursing home of liability but holding Dr.

POCSO Act, 2012 – Sections 19(1) and 21(2) – This case involves Criminal Original Petitions filed by the Principal (A2) and Secretary (A3) of a school, seeking to quash final reports in connection with a POCSO Act case. The accused, a Physical Education Teacher (A1), allegedly sexually assaulted and misbehaved with minor girl students. The petitioners are charged under Sections 19(1) and 21(2) of the POCSO Act for failing to report the offences committed by their subordinate.

The prosecution alleges that after the victims disclosed the incidents to a teacher, the petitioners enquired about the allegations but instead of reporting to the authorities, they advised the victims to remain silent.

Tamil Nadu Cultivating Tenants Protection Act, 1955 Section 2(aa), 3(4)(a) and 23 – The case involves a landlord seeking eviction of tenants and sub-tenants from agricultural land due to non-payment of lease rent and illegal sub-leasing. The landlord claims the original lease was unregistered and prohibited sub-leasing. The sub-tenants argue they are protected cultivating tenants due to a registered “made-over” deed transferring tenancy rights from the original tenants and recognition by revenue authorities.

The court finds that the “made-over” deed, transferring tenancy rights, is invalid under the Act because it was done without the landlord’s consent and the original tenants did not cease to be tenants.
