Indian Penal Code, 1860 (IPC) – Sections 302, 354, 294, 326, 324, 323, 504, 506, 509, 143, 144, 147, 148, 149, 427 – Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) – Sections 3(1)(r), 3(1)(s), 3(2)(5), 3(2)(v-a), 3(1)(w), 3(1)(g) – This appeal, filed by Shobha Namdev Sonavane, challenged the Bombay High Court’s order granting bail to the accused in a case concerning the fatal assault on her husband, Namdev. The incident, fuelled by a prior civil dispute, involved an unlawful assembly that brutally attacked Namdev with iron rods and sticks, while also subjecting the complainant to caste-based abuse. Namdev sustained multiple severe injuries, including cerebral damage, and passed away five days later, leading to a murder charge under the IPC.
The High Court had granted bail, erroneously citing the inability to attribute specific injuries to individual accused, the time gap between assault and death, and the ongoing civil litigation.
