Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (TNRRRLT Act) – Section 2(c), 4(2), 21(2)(a) – This revision petition was filed by a tenant challenging the order of the Rent Tribunal in I.A.No.3 of 2024 in RLTA.No.238 of 2023, which allowed a subsequent purchaser to be impleaded in the Rent Law Tribunal Appeal (RLTA). The tenant argued that the purchaser had no cause of action and that accepting rent created a new tenancy, barring eviction. The landlord’s counsel argued that as a successor-in-interest, the purchaser inherited the vendor’s rights, including the eviction order.

The High Court noted that the original eviction petition was filed under Section 21(2)(a) of the TNRRRLT Act, alleging failure to enter into a tenancy agreement as per Section 4(2).

Code of Civil Procedure, 1908 (CPC) – Section 151, Order 38 Rule 5 & 11(b) – This revision petition was filed by the plaintiff in a suit for recovery of money, challenging the Trial Court’s order that dismissed I.A. No.1 of 2021. The plaintiff sought to set aside a sale deed executed by the defendants, arguing they violated an undertaking given to the Court to furnish security for the suit claim. The defendants, however, disposed of the property to a third party (5th respondent).

The petitioner, wife of the detenu Arul, challenges the detention order issued against her husband under the Goondas Act. The detenu was accused in a crime involving the death of one Mr. Armstrong and was branded as a Goonda due to his alleged involvement, deemed prejudicial to public order.

The primary argument is that the detaining authority passed the order on the same day the proposal was received, making it impossible to properly review the extensive materials (around 1000 pages).

The petitioner, mother of the detenu Hariharan, filed a Habeas Corpus Petition challenging the detention order issued by the second respondent, branding her son as a “Goonda” under the Tamil Nadu Act 14 of 1982.

The detenu was accused in Crime No.293 of 2024 for involvement in a murder. The detaining authority believed he posed a threat to public order.

The primary contention was that the detention order was passed on the same day the proposal was received, making it impossible to properly review the 1000-page document.

Code of Criminal Procedure, 1973 (CrPC) – Sections 193, 209, and 319 – This case concerns a challenge to an order by the Allahabad High Court upholding a trial court’s decision to summon the petitioner as an accused under Section 193 of the CrPC, despite the police initially dropping his name from the chargesheet. The original case involved offences punishable under Sections 302 (murder) and 376 (rape) of the Indian Penal Code, 1860 (IPC).

The petitioner argued that the trial court could only summon him after recording oral evidence under Section 319 CrPC, and that Section 193 CrPC could not be invoked as the Magistrate had already taken cognizance of the offence when committing the case to the Sessions Court.

The Supreme Court framed the main issue as whether a Sessions Court can summon a person as an accused under Section 193 CrPC, without recording evidence, based on materials in the police report, independently of Section 319 CrPC.

Motor Vehicles Act, 1988 – Section 166 – This case involves an appeal against a High Court judgment that overturned a Motor Accident Claims Tribunal (MACT) award. The MACT had initially granted compensation to the appellants (claimants) for the death of their family member in a road accident involving a mini-truck.

The High Court reversed the MACT’s decision, primarily based on the statement of one of the claimants (PW-2) to the police, suggesting the deceased fell due to his own negligence and the non-examination of another potential witness. The High Court reasoned that the accident involving the mini-truck was doubtful.

Land Acquisition Act, 1894 – Section 4(1), 18, 28A & Legal Services Authorities Act, 1987 – Chapter VI – The Tamil Nadu Housing Board filed a writ petition seeking to quash the Lok Adalat award dated 08.04.2017 in L.A.O.P.No.83 of 2008, which enhanced compensation for land acquired for the ‘Ellis Nagar Housing Scheme’ in Madurai.

The land acquisition process began in 1979, and an award was passed in 1982 fixing compensation at Rs.295.45/- per cent. Dissatisfied, the third respondent requested a reference under Section 18 of the Land Acquisition Act. Subsequently, based on a higher compensation awarded for similar land, the third respondent invoked Section 28A, seeking enhancement.

Guardian and Wards Act, 1890 – Section 25 & Hindu Minority and Guardianship Act, 1956 – Section 6 – This case concerns an appeal against an order that granted custody of a minor child, V.Sai Varun, to his maternal grandparents and family members. The appellant, the child’s biological father, filed the original petition under Section 25 of the Guardian and Wards Act, 1890, seeking custody after his wife, the child’s mother, passed away.

The primary contention of the appellant was that he was denied custody and prevented from meeting his child, despite being capable of providing a stable and healthy environment. The respondents (maternal family) argued that the child was emotionally attached to them and that the father showed a lack of interest in child rearing.

Indian Penal Code, 1860 (IPC) – Section 305 – This Criminal Appeal was filed against the judgment of the Sessions Judge, Magalir Neethimandram (Mahila Court), Coimbatore, which convicted the appellants under Section 305 of the IPC for abetment of suicide and sentenced them to three years of rigorous imprisonment with a fine. The case arose from an incident where the appellants verbally abused and threatened a minor girl for having a love affair, leading her to commit suicide.

The prosecution presented evidence including the victim’s dying declaration, eyewitness testimonies, and other documentary evidence. The appellants denied the charges, claiming the admonishment was reasonable given the social context.

Indian Penal Code, 1860 (IPC) – Sections 341, 323, 326, 324 – Tamil Nadu Prevention of Property Damage and Loss Act, Section 3(1) – Assault and Damage to Property – Reliability of Injured Witness – Delay in FIR – Accident Register (AR) Copy.

The High Court affirmed convictions for assault and property damage, holding that the testimony of an injured witness, if cogent and corroborated by medical evidence, holds strong evidentiary value. It ruled that minor inconsistencies or delays in FIR registration, especially when the injured was hospitalized, do not automatically discredit the prosecution’s case, nor does an entry in an AR copy about “unknown persons” when a clear identification is made in court.

Final Decision:   The appeal is partially allowed.
