Arbitration and Conciliation Act, 1996 – Section 2(1)(h), 31(5) and 34 – This case concerns the validity of an application filed under Section 34 of the Arbitration and Conciliation Act, 1996, to set aside an arbitral award. The key issue is whether the limitation period for filing the Section 34 application commenced when a xerox copy of the award, duly signed by the arbitrator, was received by an authorized representative of the State.

The High Court had ruled that the limitation period only begins when the award is served on the Secretary, Irrigation and Waterways Department, or the Executive Engineer, as they are considered the ‘party’ under Section 2(1)(h) of the Act. The appellant argued that the authorized representative’s knowledge of the award should be considered as knowledge of the State.

Tamil Nadu Advocates Welfare Fund Act, 1987 – Section 13 – This case involves a writ petition filed by the Women Lawyers Association of Nilgiris, challenging the rejection of their application for recognition and registration by the Bar Council of Tamil Nadu and Puducherry. This deduction, based on Order XVII Rule 10(i) of the Insolvency Rules 1958, was challenged as reducing the dividend payable to creditors.

The applicant argued that the commission should only apply to amounts paid to creditors under a composition or scheme of arrangement, as per Section 28 of the Act. The respondents contended the deduction was lawful and long-standing practice, authorized by the High Court’s rules.

The writ petition challenged an order directing parties to approach a civil court to ascertain property rights, with an interim status quo order allowing worship without construction. The petitioner claimed respondents 2 to 6 violated the order by erecting new constructions.

The court noted that the petitioner’s writ petition was dismissed, observing that she was an encroacher under the Waqf Act, 1995.

The Tamil Nadu Minor Inams (Abolition and Conversion Into Ryotwari) Act, 1963 (Act XXX of 1963) Section 2(4), 2(7) – This writ petition challenged a notice issued under Rule 9(5) of the Tamil Nadu Minor Inams (Abolition and Conversion Into Ryotwari) Rules, 1965, regarding a proposal to issue ryotwari patta for certain lands. The petitioner claimed entitlement to 931 acres of land in Nilayapatti Village, which were taken over by the Government under The Tamil Nadu Inam Estates (Abolition and Conversion into Ryotwari) Act, 1963 (Act XXVI of 1963).

Earlier, civil suits had declared that the subject lands were not an “Inam Estate” under Act XXVI of 1963. The Government then initiated proceedings under Act XXX of 1963, leading to the challenged notice.

Trademarks Act, 1999 – Section 124 – This revision petition contests the Commercial Court’s order dated 09.06.2025 regarding the framing of issues in a commercial suit (C.O.S.No.2 of 2025). The suit involves a dispute over the trademark “Anugraha,” with the plaintiff seeking injunctions against the defendants’ use of the mark.

The petitioners (defendants) argued that the Commercial Court failed to frame a crucial issue regarding the invalidity of the plaintiff’s trademark registration, preventing them from seeking rectification under Section 124 of the Trademarks Act. They contended that “Anugraha” is a common word and the plaintiff falsely claimed it as a coined term to obtain registration.

Motor Vehicles Act, 1988 – Section 166 – This Civil Miscellaneous Appeal challenges the award passed by the Motor Accident Claims Tribunal, Thiruchirappalli, in M.C.O.P.No.931 of 2019, dated 21.06.2023. The respondents/claimants, daughters of the deceased’s brother, sought compensation for the death of their paternal uncle Pichaipillai, who died in an accident caused by a two-wheeler insured with the appellant Insurance Company.
